FROM: David Rivera: Principal Planner

PROJECT: T13CM03776

Additions: Carport, Storage, detached Accessory Structure and Porch

TRANSMITTAL: This review has been done based on the information drawn on the submitted Drawing. The site is under a Notice of Violation (T12DV02209) for building without permits.

COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment (UDC Section 3.10.1).

This site is located in the R-2 zone (UDC 4.7.9). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.6, .9 & .10.

The minimum building setback is the greater of six (6) feet, or two-thirds (2/3) the height of the structure's wall facing each interior property line (Table 6.3-2.A).

The minimum building setback within a developing area is the greater of twenty (21) feet, or the height of the proposed wall from the existing or future back of curb location when the ADT is 1,000 or greater, (UDC 6.4.5.C.2.a). Valencia Road

The minimum building setback within a developing area is the greater of twenty (21) feet, or the height of the proposed wall from the nearest edge of travel lane when the ADT is 140 to 1,000, (UDC 6.4.5.C.2.a). Fontana Avenue

The minimum driveway length to the edge of a sidewalk for a garage is nineteen (19) feet (UDC Section 6.4.5.C.2.b.1). The minimum driveway length for a garage is eighteen feet to the property line (UDC Section 6.4.5.C.2.b.1.a & b). Along Fontana Avenue

(UDC Section 6.6.3.B) Detached accessory buildings are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line, except for terraces and steps not over three feet high above the natural grade, paved areas, and fences or walls;

See Variance Comments below,

1. The owner has constructed a structure along the Valencia Road street perimeter yard which meets the current building setback based on the current location of the Valencia Road back of curb location but does not comply with the future building setback based on future roadway widening and curb location. Owner is requesting a variance to allow the existing structure within the future building setback until such time as the future Right of Way is obtained and Roadway constructed. The portion of the building that was constructed without permits will be within the future right of-way.

2. The owner has constructed a two (2) car carport structure along the Fontana Avenue street perimeter yard which does not meet the minimum driveway length of Eighteen feet in front of a Carport to the Fontana Avenue street property line (UDC Section 6.4.5.C.2.b.1.a & b). The structure has been constructed eleven feet, eight inches from the property line to the Carport structure. The owner is requesting a variance to allow the carport structure to remain at Eleven feet, Eight inches as drawn on the site plan.

3. The owner has begun construction on a detached accessory structure along the Fontana Avenue street (northwest corner of the property) perimeter yard which does not comply with (UDC Section 6.6.3.B). Owner is requesting a variance to allow the detached accessory structure to be completed and remain in the street perimeter yard as drawn on the site plan. The accessory structure is also non-compliant for the interior building setback adjacent to a residential zone. The required building setback is based on the greater of six feet or two-thirds the height of the structure, (UDC Table 6.3-2.A). The owner has begun construction of the accessory structure at one foot eight inches (1'-8") from the property line.

4. The owner has constructed an attached structure along the east perimeter yard setback which does not comply with (UDC Table 6.3-2.A). Owner is requesting a variance to allow the attached structure to remain as drawn on the site plan. The required building setback is based on the greater of six feet or two-thirds the height of the structure, (UDC Table 6.3-2.A). The owner has constructed the structure at One foot, Seven inches (1'-7") on the north corner of the structure to Two feet, Three inches (2'-3") at the south corner of the structure from the east property line.

(Note: Permits for all unpermitted structures will have to be obtained at time of PDSD approval.)
