TRANSMITTAL DATE: March 25, 2013

COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The plans have been reviewed for compliance with the development criteria requirements applicable to a Proposed Medical Marijuana Dispensary Offsite Cultivation Location, and subject to compliance with the UDC section criteria 4.9.9.E.2 and 4.9.13.Q.

2. Dimension the excluded area of the building that is not part of this permit in order to verify the proposed square footage of the Cultivation area.

3. The door that is key-noted #5 on sheet CS1.0 for removal an infill must be keynoted on all plan sheets where the door is shown. Revise the plans sheet to show a wall or add the key-note listed on sheet CS1.0.

4. Add the following zoning data information. (The use is listed under the retail trade use group in the UDC)
The zoning of the property, (I-2)
The specific use as listed in the UDC, including the subject to sections,
The number of parking spaces required for this use (based on a 1 to 300 ratio for the overall square footage of 2999.15) number of spaces required and number provided,
Bicycle parking requirements, long and short term facilities, number of spaces require and provided for each,
If a loading zone is proposed it must be drawn and labeled on the plans,
Add a note that the site is within the Davis Monthan Air Force Base Vicinity of the Paddle,

Add the following notes to the cover sheet verbatim:

4.9.9.E.2 : Medical Marijuana Dispensary Off-site Cultivation Location

a. The total maximum floor area of a medical marijuana dispensary offsite cultivation location shall not exceed 3,000 square feet.
b. The secure storage area for the medical marijuana stored at the medical marijuana dispensary off-site cultivation location shall not exceed 1,000 square feet of the 3,000 square foot total maximum floor area of a medical marijuana dispensary off-site cultivation location.
c. A medical marijuana dispensary off-site cultivation location shall be located in a permanent building and shall not be located in a trailer, cargo container, mobile or modular unit, mobile home, recreational vehicle, or other motor vehicle. "Building" shall have the meaning provided in Section 11.4.
d. A medical marijuana dispensary off-site cultivation location shall be setback a minimum of 2,000 feet from any other medical marijuana dispensaries or medical marijuana dispensary off-site cultivation locations measured in a straight and direct horizontal line between the two closest exterior walls of medical marijuana dispensaries' cultivation locations.
e. A medical marijuana dispensary off-site cultivation location shall be setback a minimum of 1,000 feet from a public, private or charter school or a licensed childcare center measured in a straight and direct horizontal line from the closest exterior wall of the medical marijuana off-site cultivation location to the nearest property line of a school or childcare center. Exception. For the purposes of this section, the following uses are not considered schools, and therefore, exempt from the setback requirement: 1) school administrative offices not located on or contiguous with a school site; and, 2) except as provided in Section 4.9.9.E.k, athletic fields or playgrounds used for school functions that are not contiguous with a school site.
f. A medical marijuana dispensary off-site cultivation location shall be setback a minimum of 1,000 feet from a public park listed in Section 6: Medical Marijuana Dispensary and Dispensary Off-Site Cultivation Uses -
Required Setback from Certain Parks, of the Technical Standards Manual, a church or library and a minimum of 2,000 feet from a licensed residential substance abuse diagnostic and treatment facility or other licensed residential drug or alcohol rehabilitation facility measured in a straight and direct horizontal line from the closest wall of the medical marijuana dispensary off-site cultivation location to the closes property line of a church, library, public park, licensed residential substance abuse diagnostic and treatment facility, or other licensed drug or alcohol rehabilitation facility. A "church" means a Unified Development Code Article 4: Zones
4.9 Use-Specific Standards building that is erected or converted for use as a church, where services
are regularly convened that is used primarily for religious worship and schooling and that a reasonable person would conclude is a church by reason of design, signs, or other architectural features.
g. A medical marijuana off-site cultivation location shall comply with all lawful, applicable health regulations, including those promulgated by the Arizona Department of Health Services and any other authorized regulatory agency.

Q. Park Industrial (P-1), Light Industrial (I-1), and Heavy Industrial (I-2) Zones -
General Restrictions
1. The use, storage, or disposal of radioactive materials must be done in accordance with Section 4.9.5.F, Radioactive Material Restrictions.
2. On land uses in the Industrial Use Group, traffic circulation must be designed so that access to the site is from a major street or from a local street which is not an internal residential neighborhood street and which does not provide access to residentially zoned areas unless no alternative exists.
3. The following special exception uses in the I-2 zone must be at least 300 feet from any non-industrial zone. Exception: the 300-foot setback is not required when the use of the non-industrially zoned property is a railroad or freeway right-of-way.
a. Extraction;
b. Hazardous Material Manufacturing;
c. Perishable Goods Manufacturing;
d. Primary Manufacturing;
e. Refining; or
f. Salvaging and Recycling.
4. Use must comply with the applicable standards of Section 4.9.5, Industrial Us Group.

5. Revise the zoning labels on the site plan as redlined.

6. Demonstrate on the plan how the handicapped parking space meets code and accessible requirements, such as ramps if needed and accessible route. The handicapped spaces is new and should comply with current requirements, If this is a required van accessible parking space label it as such.

7. No expansion is allowed above the 3,000 square feet allowed by the COT Ordinance 10850.

8. Demonstrate compliance specifically with UDC section 4.9.9.E.2.b. add notes, dimensions and calculations as needed to ensure compliance.

9. If changes are made to the drawing sheets and require signatures form plans reviewers that have already approved and signed the plans please ensure that all the plan sheets are re-stamped.
