COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).


This site is located in the C-1 zone (UDC 4.7.20). A Food Service use in permitted in this zone (Table 4.8-4). See Use-Specific Standards 4.9.4.M.

In nonresidential zones (C-1), walls or fences, may exceed the height standards, provided the wall or fence complies with side and rear yard standards applicable to buildings on site (UDC Section 6.6.2.J).

The required setback to the property line adjacent to a residential zone is one and one-half the height of the proposed structure (UDC Table 6.3-4.A). The height of the proposed wall is eight (8) feet. The required setback to the east property line is twelve (12) feet. The proposed setback is zero.
