Kolb Rd., Tucson, Arizona, 85756 PROPERTY OWNER'S NAME: Pima County and City of Tucson The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as (legal description): The south 367.59' of the north 2417.07' of the east 474.01' of the west 549.01' of the west half, being 4 Acres, all in Section 20, T-15-S, R-15-E for the purpose of constructing an underpass adjacent to an existing CBC in the Julian Wash at the Kolb Road crossing known as: Utility plan for Julian Wash Trail Kolb Road Crossing. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal (FEMA), State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following conditions shall apply to this permit. (Or refer to Chapter 26 page 35) 1. All work shall conform to the attached plans (Drainage Report/excerpts/references to and/or all improvement plans) which are made part of this permit and were supplied/implied and submitted by the Pima County Flood Control District. 2. The existing drainage patterns at the property lines shall not be obstructed. 3. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T12OT01387. For information please call 791-5550." 4. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. (see cond. no. 7) 5. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development. 6. Adhere to note 37 of the attached plans; Pima County will satisfy the Federal, State and City of Tucson Floodplain requirements not limited what in shown on the plans etc. 7. Pima County Flood Control District has reviewed the construction documents and drainage reports and agrees to the data contained in those reports, which concludes that there are no adverse impacts i.e. flooding down stream of the improvements (La Estancia Subdivision) will occur due to the additional 10'x11' PRCB in the Julian Wash @ Kolb Road Crossing. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Section.
