The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: Parcel 115-08-0890, 1240 N 7TH AV, HIGHLAND PARK AMENDED ALL OF BLOCK 19, in a portion of Township 14 South, Range 13 East, Section 1, for the purpose of communications equipment improvements including concrete platform/pad for back-up generator, located on the west side of parcel within existing communication equipment enclosure area just on the east side of the fake palm, within the Mabel Street Wash Watershed. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following 10 conditions apply to permit T12OT01065: 1) Call for Pre-construction meeting, elevation certification inspections, and final inspections. For a PDSD Engineering Inspection, call IVR (740-6970), or contact PDSD Engineering at 837-4991, or schedule inspections online at: http://www.ci.tucson.az.us/dsd/Online_Services/Online_Permits/online_permits.html 2) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times. 3) PDSD Engineering Inspections are required prior to final floodplain inspection. 4) From floodplain data derived from Hydrology Report for prepared & sealed 04/19/07 by Ian Sharp, P.E. of JE Fuller, the BFE = 2380.14 NAVD88 derived from sections 30013 & 30014. Minimum FFE elevation = 2381.14. 5) Submit Elevation certification(s) by a Land Surveyor registered in Arizona for the pad for the generator to be installed at the north side of the enclosed equipment yard, just east of the existing fake palm. Submit Elevation Certifications by a Land Surveyor registered in the State of Arizona for pad elevation (prior to pouring slab), and later for finished construction. PDSD Engineering has the preliminary elevation certificate filled out for the RLS to use, as needed. First elevation certificate must be submitted prior to pouring concrete slab to assure minimum height is achieved. Concrete slab may not be poured until PDSD Engineering accepts Building-Under-Construction elevation certificate. Submit color photos for Item A6 of the Finished Construction Elevation Certificate. Approved Final El Cert is required prior to final approval of permits for this development; assure the El Certs are provided to the City of Tucson PDSD Engineering Division. 6) All work shall conform to the approved plans shown on the associated approved building permit T12CM04329 which should show minimum finished concrete pad elevation of 2381.14. 7) Disturbance of the floodplain is only permitted as per approved construction plans. 8) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T10OT01065. FOR INFORMATION PLEASE CALL 791-5550." 9) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 10) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division.
