T12OT00977 PROPERT ADDRESS: 4262 N 1st Avenue Tucson, AZ 85705 PROPERTY OWNER'S NAME: Continental 61 Fund OWNER'S ADDRESS: W 134 N 8675 Executive Parkway Menomonee Falls, WI 53051-3310 The Applicant/Owner is authorized to use a portion of the City of Tucson Flood Hazard Area, as delineated on the approved Site Plan as a result of an approved hydrology study for the property described as: Lots 1-2 a resubdivision of Lot 12 and portions of Lots 9 and 11 of Hynes Rillito (Bk 3, Pg 8, M&P,, P.C.R.), A portion of the NW ¼ of the SW ¼ of SEC 19, T13S, R14E, G&SRM, Tucson, Pima County AZ. For the purpose of constructing a building expansion and all associated earth work, pavement and drainage structures, within a regulatory floodplain area as shown on the subject project Development Package Plan, Case #DP12-0064 (see plans for additional details). The approved Development Package Plan becomes part of this Floodplain Use Permit. The Applicant/owner agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the Applicant/Owner. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following conditions shall apply to this permit (Refer to Chapter 26 "FLOODPLAIN, STORMWATER AND EROSION HAZARD MANAGEMENT" for additional information): 1. All work shall conform to the attached plans, which are made part of this permit. 2. No fill shall be placed in any floodway; nor shall any fill be placed where it diverts, retards or obstructs the flow of water to such an extent that it creates a danger or hazard to life or property in the area. 3. Any disturbed soil, outside the landscape area, shall be treated based on the geotechnical engineer recommendations and shall be compacted to least 95% density. 4. The existing drainage patterns shall not be obstructed or diverted other than what is shown on the attached approved grading plan. 5. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Permit No. T12OT00977. For information please call 791-5550, ext. 195.". 6. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 7. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit. Additionally, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning and Development Services Department, Engineering Division. This permit may be renewed for up to one year at the sole discretion of the City Engineer or designated representatives.
