08/28/2012 LOREN MAKUS ENGINEERING REVIEW Approved The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as 9163 East Old Spanish Trail for the purpose of making improvements associated with the development of the site as a multifamily residential community.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit.

1. All work shall conform to the attached plans (DP12-0061) which are made part of this permit.

2. There will be no disturbance of floodplain areas except as shown on the approved Development Package plans.

3. Within the mapped floodplain, the proposed sewer lines shall be installed within the existing Gollob Road right-of-way. The disturbed area will be returned to existing conditions so the flow within the wash is not adversely affected. If the sewer line is not installed within the paved portion of the roadway, it shall be installed within areas previously cleared of vegetation.

4. The existing drainage patterns at the property lines shall not be obstructed.

6. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

7. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.


This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.
