This parcel lies in a FEMA Zone X-Unshaded (map number 040076 C 2900L) with local jurisdictional floodplain at the site, which is also within a critical basin management area of the Rodeo Wash Watershed (BR). The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

Parcel 140-39-052F, 5300 E LOS REALES RD, SELY PTN S2 SE4 & PTN N30' E2 ABAND LOS REALES RD 44.79 AC, in a portion of Township 15 South, Range 14 East, Section 14,

for the purpose of internal drainage improvements, road construction, and entrance facility construction for the Los Reales Landfill project.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 11 conditions apply to permits T12OT00427, T12BU00348:
1) Call for Pre-construction meeting, intermediate inspections, and final inspections. 2) PDSD Engineering Inspections are required prior to SWPPP installation, during completion of the drainage improvements, and prior to final floodplain and grading inspections.
3) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T12OT00427. FOR INFORMATION PLEASE CALL 791-5550."
4) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. Call PDSD Engineering to discuss any proposed changes, to determine if change needs only a simple detail, or whether the change may be made without revision submittal.
5) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
6) All work shall conform to the approved permits, plans, approved drainage and soils reports, for the Los Reales Landfill Entrance, which is made part of this permit.
7) See the associated grading plan T12BU00348.
8) If permit expiration is expected, contact PDSD to extend the permit(s).
9) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.
10) Disturbance of the floodplain is only permitted as per the approved construction plans. Other than those areas shown on the approved plans, there shall be no wash off area, temporary chemical storage area, temporary refuse area, or other construction storage within the floodplain areas as determined by the approved Drainage Report. Any wash off area, temporary chemical storage area, temporary refuse area, and / or vehicle storage areas shall be placed in non-floodplain areas and shall have interim stormwater controls installed along downstream side of these areas. Downstream side of the construction area shall have interim erosion and sediment controls installed and maintained until all disturbed areas are constructed with buildings, pavement, curb, sidewalk, approved permanent erosion protection controls such as gravel, and/or revegetation.
11) As-builts shall be submitted under the grading permit activity number T12BU00348 to PDSD Permit Clerks as a Final Revised Grading Plan package. This package shall include: cover letter with summary description of any changes to project, 2 copies of only those sheets that have as-built changes, substantial completion letters from EOR and soils engineer. As-built data shall include as-built FFE's for all constructed buildings, as-built elevations for inverts of drainage systems, and other general as-built spot elevations as deemed necessary by RLS.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire two years from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division.
