T12CM05232 is Denied. 1) This site is located in the River Walk townhouse subdivision. The Zoning is R-3 RCP-7 at this location (LUC Sections 2.3.6.2.A.3, 3.2.3.1.F & 3.6.1). 2) There are Board of Adjustment conditions associated with the variances granted for this subdivision (C10-05-10). There are also re-zoning conditions associated with this subdivision (C9-04-04). The individual single-family-houses (SFR) proposed on combined lots and/or parcels are a significant departure from the approved townhouse subdivision for which the re-zoning and the BOA variances were granted. 3) Please contact Russlyn Wells about a determination concerning the BOA conditions. These changes to the plat my need to go before the Board of Adjustment for review. 4) Please contact Michael Wyneken concerning the re-zoning conditions for this plat. The changes proposed may require approval from the Mayor and Council. 5) The most obvious conditions not being provided with the plot plan are the four-sided architecture elevations (Condition 14) and the "Proposed buildings adjacent to existing residential structures" must match the adjacent structures height, unless there is eighty (80) feet of separation, or sixty (60) feet of separation with mature landscaping (Condition 16). |
