Prior to approval of the plot and building plans a building setback variance approval through the Design Development Option process is required, to allow the proposed building setbacks of 3 (three) feet along the east property line for a attached carport and storage shed. The structures were constructed without permits by the previous owner. The new owner is trying to rectify the violation and permit the structures as mentioned in the comments section above.

1. A DDO is required for to allow the 3' (three-foot) building setback for the carport and storage shed along the east property line. The exterior building wall height is listed as 7'-2" tall. The required building setback is based on the greatest of (six feet or 2/3rds) the height of the existing height of the exterior wall. The minimum building setback required is six (6) feet.

LUC section 2.2.6.4 perimeter yard matrix designator (AA) adjacent to R-1, the greatest of six (6) or 2/3 the height of the wall.

It is recognized by the Zoning Review Section that this site has been accepted as non-conforming for two (2) units on an R-1 Property with less than 10,000 square feet. A letter by the zoning administrator staff (William Balak) has established the non-conforming status per a letter dated 10-31-2007. Per discussion with management, the proposed or illegally built structures will not cause a loss of non-conforming status of the use. The expansion does not create an additional unit and does not create additional bedrooms that would require compliance with Performance Criteria 3.5.7.1. Any additional expansion could create a loss of non-conforming status.
