This application proposes work not permitted by the Stipulation. Exhibit 9, Section 4(e) prohibits a change in the dimensions of supporting poles or beam, which the application describes in the Scope of Work on Sheet 2A and depicts on Sheet 2B. Furthermore, Exhibit 9, Section 4(k) otherwise prohibits structural alterations in addition to those enumerated in Section 4, unless such alterations are similar in nature and kind to those expressly allowed in Exhibit 9. There are no alterations in Exhibit 9 that are allowed and similar in nature and kind to the alterations proposed here (removing the damaged sections of the beams and thereby changing their dimensions). |
