The replacement of scabs is not provided for under Exhibit 9, Section 2 of the Stipulation; a request for consideration of such an unspecified repair may be submitted per Subparagraph 10.7 of the Stipulation. [Note: the Billboard Review Committee does not concur that scabs are an integral part of the supporting pole (as part of original construction design), but rather add-ons that were later installed to elevate face panel height above that of original construction]. These comments were based on the language of Stipulation found in: Subparagraph 10.1 (providing that the types of future authorized repairs and alterations are specified in Paragraph 10 and Exhibit 9); Subparagraph 10.2 (providing that Clear Channel has a right to make such repairs authorized by Paragraph 10 on billboards deemed to be nonconforming under the Stipulation); and Subparagraph 10.7 (addressing unspecified repairs or alterations). The replacement of scabs is an unspecified repair, as authorization for the replacement of such parts is not to be found anywhere in Paragraph 10 or Exhibit 9 (the Section 2 list in particular for the latter). The only basis for allowing such replacement is Subparagraph 10.7 and then only if "agreed to in writing by the City, in the form of a letter signed by the City Attorney or the City Development Services Director, subject to any applicable requirements to obtain a permit". Clear Channel has not made any request under Subparagraph 10.7 to the knowledge of the BRC. Rather, Clear Channel has first stated that scabs are integral part of the wood supporting poles (November 15, 2013 Letter). However, as noted in the BRC comments from December 18, 2013, such scabs have never been found in the review of dozens of plansets for the original engineered construction of wood pole billboards. If anything, scabs are more in the nature of supports for extensions, the latter of which are expressly prohibited by Subparagraph 10.3.1(e). Clear Channel now appears to base authorization of scab replacement on the billboard being deemed nonconforming under the Stipulation (February 27, 2014 PDSD Meeting). That assertion, however, does not in itself support the replacement of scabs or any other billboard part, as the Stipulation itself governs what billboard parts may and may not be replaced (in effect determining with far greater specificity what constitutes "reasonable repair and alteration" under A.R.S. Sec 9-462.02(A)). Given the foregoing, BRC Comment #3 remains appropriate. Should Clear Channel submit a written request pursuant to Subparagraph 10.7, the BRC can further review the issue). BRC Comments Revised 12/23/13 Below are revised comments on the authorized repair submittal for COT ID# 588 at 12501 East Interstate 10 (T12BU00195). After the previous comments were posted, additional information has become available regarding the length of time the leading (south/west) plywood sheet face panel (4' x 10') has not been in place. The revised comments are based on this plywood sheet face panel not having been in place for a period since prior to July 23, 2012 through November 19, 2013, the date that the current application was submitted. Sheet 1 of 2 1. In Billboard Note #9, delete reference to "I" (there are no existing or proposed catwalks on this billboard). 2. Revise property line depicted to accurate location (it appears that the Pima County Mapguide line is being used, but this depiction is in error and does not match the ADOT right-of-way fence or ADOT angle iron and brass cap markers). 3. In Billboard Note #5, change face size from 10' x 40' to a 10' x 36. [Added 12/23/13] Sheet 2 of 2 1. In fourth paragraph of Notes and Specifications, delete the reference to "I" (there are no existing or proposed catwalks on this billboard). 2. The replacement of scabs is not provided for under Exhibit 9, Section 2 of the Stipulation; a request for consideration of such an unspecified repair may be submitted per Subparagraph 10.7 of the Stipulation. [Note: the Billboard Review Committee does not concur that scabs are an integral part of the supporting pole (as part of original construction design), but rather add-ons that were later installed to elevate face panel height above that of original construction]. 3. In Title Block, Plan Elevation & Scope of Work, change the horizontal face dimensions from 40 feet to 36 feet, the face depiction to match, and the number of plywood sheet panels from ten (10) to nine (9), where applicable. Add prominent, freestanding note: replacement of two supporting poles is pursuant to Exhibit 9, Section 2(a) of the Stipulation and exhausts the cumulative allowance under this provision; no further supporting pole replacement may occur on this billboard. [Note: a prior submittal on this billboard indicated the replacement of only one supporting pole, not two] 5. Where applicable, change cumulative horizontal lengths of replacement stringers and backrails so as not to exceed 36 feet (replacement stringers and backrails may be horizontally realigned so as to be centered on the underlying supporting poles). [Added 12/23/13] 6. In fifth and eleventh paragraphs of Scope of Work and Typical Section Thru Sign, delete references to catwalks.
