The proposed use falls under the LUC Sec. 2.3.5.3 Special Exception Land Uses, Commercial Services Use Group, Sec. 6.3.5. Communications "41", limited to wireless communication towers and antennae, subject to: Sec. 3.5.4.20.B, .C, and .G
1. The submitted plan, showing the proposed new cell tower is acceptable to continue the review for the zoning examiner's report.
2. Documentation will be required clearly indicating that a reduction in the number of parking spaces will not reduce the number of parking spaces below the number of required parking spaces. Last approved site plan will be required to be provided.
3. The parking spaces adjacent to the east wall of the proposed enclosure will be required to be a minimum of 10' in width. See Development Standards 3-05.2.1.B.3.
4. Provide a dimension from the west side of the walled enclosure to the west property line.

Kino Area Plan and the General Plan

This proposal is for a special exception use in the R-2 zone, to allow a wireless communication facility within the Thomas O Price Service Center/Ward 5 Council Office site located at 4300 S. Park Avenue. The site is located southwest from the intersection of Park Avenue and Ajo Way. The applicant is proposing a 70-foot tall monopalm and associated ground equipment within a 32 X 18 foot lease area that will be enclosed by an 8-foot tall CMU block wall designed with a two foot wide vented opening on the west elevation and a four foot wide metal gate on the south elevation and a top sun fabric cover. Access is proposed from S. Park Avenue via a 12-foot wide ingress/egress easement. According to the Major Streets and Routes Plan, Park Avenue is an arterial street.
Surrounding Land Uses and Zones: - The Thomas O. Price Service Center is zoned I-1 and R-2, a light industrial zone and a residential zone, respectfully. To the east across Park Avenue is the Tucson Business Park, an industrial subdivision zoned I-1 light industrial; to the south across Fair Street is Park Lane East Annex, an industrial subdivision zoned I-1 light industrial; to the west across the Union Pacific Railroad right-of-way is a residential neighborhood zoned R-2, residential; and to the north across Ajo Way is the Solomon Industrial Park an industrial subdivision zoned I-1 light industrial.

Land Use Policies: - The site is within the boundaries of the Kino Area Plan (KAP), which provides the following policy guidelines applicable to this request.

Kino Area Plan commercial subgoal, is to provide for an adequate amount and appropriate arrangement of commercial development within the Kino Plan area. Policy 1.c. is to encourage private developers to utilize existing provisions in the Land Use Code which allow the integration of appropriate commercial and supportive service activities within industrial parks. The KAP Public and Semi-Public sub-goal supports an increase on public efforts to enhance the environment and image of the Kino area. The KAP does not specifically address communication antennas.

The General Plan, under Element #4, Community Character and Design, Policy 3.7, states that whenever possible telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Further, Policy 4.6 states to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary aboveground utility lines and structures. Action 5.5A is to consider incentives for telecommunications providers to install infrastructure in older as well as newer neighborhoods, to increase opportunities for all citizens to have access to high-tech telecom services.

Sufficiency of Information to Determine Plan Compliance -
The applicant attended a rezoning pre-submittal meeting on November 17, 2010. Staff commented that appropriate design elements should be taken into consideration to mitigate impacts to the area. Staff also commented that applicant should review any site issues such as landscaping, and parking space removal needed prior to the installation of the wireless communication facility.

The applicant held a neighborhood meeting on January 6, 2011. There were no attendee's at the scheduled neighborhood meeting and therefore no minutes recorded.

Summary - Sufficient information has been provided to determine that the proposal is consistent with the land use plan policies; a plan amendment is not required. Staff supports the proposed stealth treatment of the monopalm, and the addition of live palms within close proximity and appropriate screening of the equipment compound, to mitigate visual impacts of this facility. Staff will recommend at the time that time of the full review, conditions that address; monopalm faux bark, fronds to screen all antennas and maintain the monopalm as needed to preserve its visual integrity; and if necessary, remove graffiti from the walls of the equipment compound in a timely manner.

Policy 3.7 requires that, whenever possible, telecommunication facilities be located, installed and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers will be a prime consideration in the City's acceptance and approval.
Policy 4 is to design and maintain streets to enhance their overall functional and aesthetic quality. Policy 4.6 is to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary above ground utility lines and structures.
Policy 5 is to promote neighborhood identity and visual character.
Action 5.5.A is to consider incentives for telecommunications providers to install infrastructure, not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.
