The applicant is authorized to use a portion of the flood hazard area (FEMA SFHA, Zone AE, Panel 2282L) in the City of Tucson, Arizona, on the property described 4866 East Speedway Boulevard for the purpose of demolishing an existing structure and the construction of a new commercial structure along with associated site and right of way improvements.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit.

1. All work shall conform to the approved improvement plans which are made part of this permit (T11BU01337, T11CM03169 and T10BU01446) which are for the demolition of an existing structure and for the construction of a new commercial structure.

2. The lowest floor of the new commercial structure shall be a minimum of one foot above the base flood elevation which is 2504.0 feet NAVD 88

3. The lowest finished floor and all associated facilities of the buildings in the property under this permit shall be placed a minimum of 2505.0 feet above mean sea level, NAVD 1988, as Certified by a Registered Land Surveyor. This certification must be completed and returned to the Development Services Dept., Engineering Section on the first Floor of the County/City Public Works Building at 201 N. Stone Avenue.

4. An elevation certificate must be completed and submitted before the floor slab is poured and at the final completion of the new building.

5. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

6. Any additional improvements not reflected in the current permit will be subject to separate review and additional permits.

7. This permit becomes invalid and is subject to additional floodplain review, if any required improvement permit(s') changes the configuration of the structure and or site development.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit.
The applicant is authorized by the City Engineer to receive a floodplain use permit subject to the above referenced conditions and restrictions.
