COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment.


This site is located in the SR Zone and the Development Designator is "C" (LUC Section 2.2.4.2.A.1). The Perimeter Yard Indicator is BB with a setback requirement of twenty (20) feet to all interior lot lines (LUC Section 3.2.6.4). On this site, at this time, Nebraska Road is an easement: therefore there is no street frontage and all the property lines are interior lot lines.

The addition and all proposed structures meet the required setbacks (LUC Section 3.2.6.4). The detached accessory structure also meets the setback requirement for animal shelter of fifty (50) feet (LUC Section 3.2.5.2.G).

The proposed detached accessory structure is an open multi-purpose structure. Board of Adjustment variances shall be required for this structure. The maximum height for a detached accessory structure is twelve (12) feet within residential zones (LUC Section 3.2.5.3.B). The proposed height is nineteen (19) feet at its peak.

Detached accessory structures are also limited to fifty percent (50%) of the gross floor area of the principle structure (Zoning Administrator determination letter dated May 3rd of 2006, by Walter Tellez). The proposed structure exceeds the square footage of the single-family residence (SFR).
