Arroyo Chico Area Plan and the General Plan

This proposal is for a special exception use in the I-1 zone, to allow a height extension to an existing monopole and add a new antenna array at the top of the extension. Existing height of monopole is sixty two feet and six inches (62'.6"). The proposed monopole height will be seventy six (76.') feet and top of new antenna array at eighty (80.') feet.

The site is at 2950 E. Silverlake Road, within a short segment of the street that ends in a cul-de-sac, located between Barraza-Aviation Parkway/State Route-210 and Country Club Road. According to the Major Streets and Routes Plan, Silverlake Road at this location is a local street. It should be noted that this segment of street fronting the proposed special exception site is identified on maps as either Silverlake Road or as 31st Street. On this application it will be identified as Siverlake Road. Access to the site will be from Silverlake Road, via Country Club Road. The monopole will be located east of the main building, adjacent to the east property line. The equipment lease area will be approximately 30' x 15' and enclosed within a CMU equipment shelter that is to be located next to the monopole. The perimeter of the existing wireless communication facility is currently enclosed by a chain link fence with no screening or landscaping.

Surrounding Land Uses and Zones:
To the north of the site, across Silverlake Road is R-2, a residential zone with site built single family development; to the east is I-1, Industrial zone; with industrial uses; to the south is the Barraza-Aviation Parkway zoned I-1, an Industrial zone; and to the west is a vacant State of Arizona parcel zoned I-1, an Industrial zone.

Both Silverlake Road and Country Club Road function as a boundary between the industrial uses to the south and southwest from the Plumber-Country Club Residential Neighborhood located north and east of Silverlake Road and Country Club, respectfully. The proposed site is located within a pocket of three industrial zoned parcels wedged between Silverlake Road, Country Club Road, and Barraza Aviation Parkway. The three industrial parcels are adjacent to the larger Industrial Area #3 of the Chico Area Plan, which is an industrial corridor that includes the Union Pacific Railroad and the Barraza-Aviation Parkway, State Route-210.

Policy Summary:
The site is within the bounds of the Arroyo Chico Area Plan. Although, no specific policy direction is provided for wireless communication proposals, a Plan goal is to encourage a complex mix of residential, industrial, and business uses in the Plan area, while protecting the integrity of existing neighborhoods. More specific policy direction is provided by the General Plan, in Element 4, Character and Design, under supporting Policy 3.7 that requires, if possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Visual impacts are a key consideration during the review process. General Plan, Element 4, under Policy 4.6 promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. Action 5.5A is to consider incentives for telecommunications providers to install infrastructure in older as well as newer neighborhoods, to increase opportunities for all citizens to have access to high-tech telecom services.

The site is also within the Davis-Monthan Airport Environs Zone (AEZ), which also encourages a compatible mix of land uses. Policy 1 and 2 is to ensure that new development is compatible with existing and future air force base operations of the Davis-Monthan Air force Base (DMAFB).

Sufficiency of Information to Determine Plan Compliance -
The applicant attended a rezoning pre-submittal meeting on June 30, 2010. Staff commented that appropriate design elements should be taken into consideration to mitigate negative impacts to the residential neighborhood located north across Silverlake Road. This includes screening all ground equipment (existing and proposed) with a masonry wall along the north property line where adjacent to a residential neighborhood, and slats on existing chain link fence along the east property line fence where exposed to the street view. Included in the submittal is a design compatibility report which summarized that documentation of the neighborhood meeting invitation was attached with the list of invitees. Staff requires documentation of the attendee's sign-in roster and the recording of minutes which provides the actual question and answers provide to their concerns or support of the proposed special exception.

Summary -
A plan amendment is not required; however, the applicant has not provided sufficient information to demonstrate compliance with the land use plan policies. It is recommended that this application be denied for processing until documentation is provided of the neighborhood meeting, which includes the neighborhood meeting sign-in roster and a copy of the neighborhood meeting recorded minutes. The minutes need to provide names of who asked the question and who provided the answer and a summary of the outcome of the neighborhood meeting.

Supporting Policy 3.7: Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers will be a prime consideration in the City's acceptance and approval.

C. Request a "Fair Disclosure Statement" be part of any development plans, informational brochures, and sales/rental agreements, indicating that certain types of military air and ground training activities occur at Davis-Monthan.
