| 08/27/2010 | MPADILL1 | COMMUNITY PLANNING | REVIEW | Completed | PLANNING & DEVELOPMENT SERVICES DEPARTMENT SE-10-113 AT & T - Linda Road R-3 Special Exception Northside Area Plan 08/26/10 msp This special exception request is to allow a new 60-foot tall monopalm and associated wireless communication equipment at 2550 E. Lind Road, centered along the southern boundary of the multi-family complex, which is zoned R-3, residential. The 1.72-acre parcel is one lot removed north of Fort Lowell Road and East of Tucson Boulevard on Lind Road The parcel's off-site traffic circulation is along it's perimeters on Palmer Drive, a circular drive and a public street. The applicant is proposing a 27' by 11' CMU wall enclosed lease area centered along the southern property boundary that is paved and open to the adjacent Palmer Drive. The monopalm will be approximately fifty-five (55) feet from a single-family residential property located to the east, eight (8) feet from the south property line and approximately twenty-eight (28) feet from the adjacent commercial development located south across Palmer Drive. Access to the lease site would be Palmer Drive, via Lind Road, both local streets according to the Major Streets and Routes Plan. Surrounding Land Uses and Zones - To the north, and east of the site is zoned R-1 with single family development, to the south fronting Fort Lowell is zoned C-1 with commercial development, to the west is an R-3 parcel with a plant nursery use and R-1 with single family development. Policy Summary - Policy direction is provided by the Northside Area Plan and the General Plan. The Northside Area Plan does not have explicit wireless communication facility policies. However, some general direction is provided in the Winterhaven subarea, which emphasizes the protection of the special residential character of Winterhaven with its annual Christmas light show. Also, Northside general non-residential policy 5.d supports non-residential development when appropriate design elements and buffering techniques are used to ensure sensitive design of non-residential uses on established neighborhoods. General Plan Element 4, Policy 3.7 requires that, if possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Visual impacts are a key consideration during the review process. Policy 4.6 promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. Action 5.5A is to consider incentives for telecommunications providers to install infrastructure not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services. Sufficiency of Information to Determine Plan Compliance - The applicant attended a rezoning pre-submittal meeting on February 17, 2010. Staff advised the applicant to contact the Winterhaven neighborhood association to discuss the proposed wireless communication facility. In addition, staff commented that at the time of a full review, placement of monopalm in relationship to natural palms in the complex would be evaluated to determine if additional clustering of palms would be needed to mitigate the cell tower location. The proposed location (revised since the initial rezoning presubmittal meeting of February 17, 2010), shows an existing palm and pine trees within twenty feet of the monopalm. The applicant held a neighborhood meeting on May 17, 2010. The meeting sign-in sheet indicates that there were five people in attendance, which had concerns with location and health and safety issues related to radio emissions. The applicant responded to their concerns, as outlined in the Design Compatibility Report. Summary - A plan amendment is not required; the applicant has provided sufficient information to demonstrate compliance with the land use plan policies. It is recommended that this application be accepted for processing.
