The site lies at the northeastern corner of a parcel located at 3843 E Pima Street. This site, the location of Frank's Restaurant, is adjacent to Pima Street and about 150 feet west of Alvernon Way. Access is to Pima Street, an MS&R Collector Street.

Although the front (south) portion of the parcel is located in a City-regulated flood hazard area, the proposed monopalm and equipment area are not located within a regulatory floodplain or erosion hazard area.

The communications facilities lie within the Christmas Wash and Alvernon Wash watersheds. Since both are non-designated watersheds and the site area is less than one acre, neither detention nor threshold retention are required.

No conditions are requested.

This proposal is a request for a special exception use in the C-1 Zone, to allow a new wireless communication facility designed as a 55-foot tall monopalm. The special exception site is located at 3843 E. Pima Street, in the northeast corner of the property behind Frank's Restaurant. Ancillary equipment for the facility is proposed to be enclosed by an 8-foot high CMU block wall.

Issue:
The facility was originally proposed by the applicant as a co-location on an existing TEP utility pole fronting Pima Street. But through neighborhood input the applicant has changed the preliminary design to a stand alone 55-foot high monopalm, to be located at the northeast corner of the property behind the restaurant structure. The wireless communication facility site will include a monopalm with three sectors of antennas, and ground equipment within an enclosed compound.

A new wireless communications facility use of this type is subject to Section 3.5.4.20.G.1 of the Land Use Code, and requires approval through a Zoning Examiner Legislative Procedure, Sections 5.4.1 and 5.4.3. A public hearing before the Zoning Examiner is required. The Zoning Examiner will make a recommendation to the Mayor and Council, who will render a decision to grant the use, with or without conditions, or to deny the use.

Surrounding Land Uses and Zoning:
The subject site is within the Alvernon Road / Pima Street intersection sector, and is zoned C-1: to the east is C-1 zoning; to the south is C-1 zoning; to the west is R-2 zoning (office building); and to the north is an R-2/C-1 zoning (vacant parcel). The closest residential structures are approximately 215 feet to the west, and 202 feet to the southwest across Rosemary Drive.

Land Use Plan Policy Summary:
The site is within the bounds of the Grant-Alvernon Area Plan. That plan and the City's General Plan provide policy guidance applicable to this proposal. The Grant-Alvernon Area Plan, Office and Commercial Land Use Policy 2 encourages incorporating appropriate design elements and buffering techniques during the zoning application and associated plan review processes. Policy 6 is to discourage wireless communication antennae arrays unless concealed, disguised, or collocated on existing buildings or structures.

General Plan Policy 3.7 (Element 4) requires that, if possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Visual impacts will be a key consideration during the review process. Policy 4.6 (General Plan, Element 4) promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. Action 5.5A is to consider incentives for telecommunications providers to install infrastructure in older as well as newer neighborhoods, to increase opportunities for all citizens to have access to high-tech telecom services.

Discussion:
The applicant proposes a telecommunication facility which addresses Grant-Alvernon Area Plan policy by constructing a stealth design monopalm with camouflaged antennae array at a height of fifty-one (51) feet with palm fronds up to fifty-five feet in height. In addition, the site is located within the core of the city and General Plan policy also supports installations in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.

Existing constraints on the site include a legal non-conforming commercial (restaurant) use, including its existing parking spaces. The required parking space for the telecommunication facility needs to be added not taken from an existing parking space. This will need to be addressed satisfactorily prior to development plan approval.

The proposed monopalm design was influenced by the prevailing sentiment of area residents expressed at the neighborhood meeting held by the applicant. Based on that, the applicant made a change in the design from collocating antennas on a T.E.P. pole along Pima Street frontage to a fifty-five (55) foot tall monopalm located at the northeast corner of the property, behind the restaurant. The new proposed location (northeast corner) has less street exposure with some screening provided by an adjacent commercial building (self-serve gas station) located to the east. In addition, the prevailing opinion by area residents at the neighborhood meeting was to delete the proposed wall enclosure for the ground equipment because it would encourage graffiti tagging nuisance and create a hiding place for the homeless and criminals. Plan policy supports opaque screening of ground equipment from the surrounding uses and this objective may be achieved by security fencing along with dense opaque vegetation maintained to equal at maturity what the original wall enclosure design would accomplish.

The nearest residential use is approximately 200 feet to the west across Rosemary Drive, a local street. In lieu of the proposed masonry wall and in consideration of the area residents concerns, staff can support a fence enclosure with landscape planting that at maturity will equal in height and screening density as proposed by the original eight foot tall masonry wall concept. Landscape screen to include an automated drip irrigation system that at maturity creates dense (opaque) vegetation at a height of eight feet tall, adjacent to the security fencing along its south, east, and west elevations.

Compatibility of the monopalm with exiting vertical heights in the area includes two-story structures and utility poles along both Pima Street and Alvernon Way frontage. The average two-story structure in the area is thirty (30) feet and the average utility pole is forty (40) feet. In addition, a statement from the applicant indicates there are approximately sixty-eight (68) palm trees in the surrounding area. Staff recommends the stealth concept to include dense foliage (fronds) painted to camouflage the antenna arrays. The support structure of the monopalm needs to be painted in a color mix that best resembles the area palm trees trunk and frond surface. Staff recommends the monopalm structure, paint, fronds, and ground screening/landscape be maintained in good condition year-round.

Recommendation
The proposed special exception land use for a stealth monopalm, for clearwire wireless communication facility can be supported and is in general compliance with applicable policy and the intent of the Alvernon-Grant Area Plan, and the General Plan. The following special exception conditions are recommended in support of a (stealth monopalm) wireless communication facility:

1. The top of the stealth (palm tree design) monopalm shall not exceed fifty-five feet in height.

2. Monopalm frond design shall properly camouflage the proposed antennas. Condition and repair of fronds to be properly maintained year-round. The support structure of the monopalm to be painted in a color mix that best resembles area palm trees (natural) trunk surface. The antenna arrays need to be painted in a manner to camouflages the antenna arrays with the color mix (shade/light) given off by the fronds in day light hours.

3. The following condition offers two options, based on input from a neighborhood meeting.

Option "A," This option follows the applicant's original design - Construct an eight foot tall masonry wall to completely enclose the ground equipment compound. Enclosure wall texture and paint color shall be compatible with surrounding land uses, or comply with Option "B," in lieu of masonry wall;
Option "B," This option follows neighborhood input. - Construct an eight foot tall security fence, painted to camouflage with vegetation within landscape buffer (three foot wide) along the east, south, and west fence perimeter.

4. Ground equipment security fence enclosure (Option "B") requires a landscape buffer. Landscape vegetation shall be drought-tolerant, which at maturity will provide a height to fully screen the eight foot tall perimeter fencing. Landscape vegetation shall be within the three (3) foot wide landscape buffer and only required along the south, east, and west elevation of the ground equipment enclosure and shall include year-round automated drip irrigation system.

" Supporting Policy 3.9 is to support nonresidential uses, where the scale and intensity of use will be compatible with adjacent uses, including residential development, neighborhood schools and businesses.

Element 4, Supporting Policy 3.7 requires that, whenever possible, telecommunication facilities be located, installed and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers will be a prime consideration in the City's acceptance and approval. " Policy 4.6 promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. " Policy 5 is to promote neighborhood identity and visual character.
