Previous use of the site was for an Auto Sales. Previous tenant or possibly the owner constructed a covered parking structure over a portion of the parking lot. Permits for the covered parking structure could not be found. It is assumed that the structure was built without permits. 2. The new tenant proposed to use the site as an entertainment use with food service and a jumping castle and it is not clear if the food was to be prepared on site. The existing building was to be used for the office and restrooms for the public and staff. 3. Zoning staff tried to accommodate the proposed use on this site utilizing the 10815 Ordinance. Unfortunately the requirements for compliance could not be met due to the illegal construction and proposed expansion by the tenant. Staff utilized the 2005 Aerials to verify site improvements/conditions and compared it to the 2008 Aerial and noted the discrepancies. Zoning could not grant zoning compliance to this site and permits could not be found for the expansion. 4. In addition the new tenant proposed to utilize the covered area to serve food and proposed to add a permanent jumping castle on the site. This would change the site and would create an expansion of the use. These improvements would change the site and compliance with 10815 requirements cannot be met as written. 5. Under the current process and per the proposed use the owner/tenant would be required to submit a site plan drawn to comply with Development standards 2-02 and submitted for site review and approval for the change of use. 6. Based on the proposed use and the proposed expansion the proposed use cannot be processed under the 10815 C of O ordinance and granted zoning compliance. Several variances and DSMR may be required if the owner/tenant wishes to continue to pursue the entertainment use on this site. Full code compliance would be required.
