This parcel lies within a City of Tucson identified and regulated approximate 100-year floodplain. The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

PARCEL 107-01-0820; 3153 N Sioux Ave, Tucson, AZ 85705, FLOWING WELLS PARK LOT 10 BLK 5 F W 0.29 AC. In a portion of Township 13 South, Range 13 East, Section 34, for compliance of carport, porch and roof.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions apply to this permit:

1) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
2) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
3) All structures located within a City of Tucson identified and regulated 100-year floodplain, as defined in The Floodplain and Erosion Hazard Management Ordinance, Chapter 26 of the Tucson Code (Ordinance).

EXISTING CARPORT:
4) Carport is an existing structure that is already constructed to be open to flow and does NOT consist of any electrical components. Carport is to remain as it is on site, and any future modifications to the structure are subject to further floodplain review and separate permit will be required.
5) Garage is to be constructed in a manner that ensures it is securely anchored to prevent flotation, collapsing or lateral movement.
6) Carport is to be used solely for the use of storage, parking of vehicles, and/or building access. It's to remain unfinished or constructed out of flood resistance material. Enclosure is to be constructed in a manner that will not render the structure in violation of the applicable non elevation design requirements of section 26-5 of this chapter.
7) No electrical components are located within existing carport. No machinery and equipment which service the garage barn such as furnaces, air conditioners, heat pumps, hot water heaters, washers, dryers, elevator lift equipment, electrical junction and circuit breaker boxes, and food freezers are permitted.
8) Carport is to remain unfinished or flood resistant.

EXISTING PORCH:
9) The proposed improvements shall not impose conditions that would increase the flood damage potential to the combined proposed and existing building, by 50 percent or greater of the existing structure's value.
10) An estimate of ($2,193.75) was provided by the City of Tucson - Planning and Development Services, Residential Department, showing that the improvements are less than 50 % (estimate was 11%) of the assessed value of the structure per the Pima County Assessor Property Inquiry (2010) (excluding land value - $20,170.00). No person shall repair or alter property in a piecemeal manner so as to avoid the provisions of Section 26-4.1.a.3, Chapter 26-Tucson Code. The estimate will be recorded and any future improvements will be added to it.

NEW ROOF:
11) Per Planning and Development Services, Zoning Department, applicant has been required to provide a roof over walkway from existing home to carport.
12) Roof is to be constructed as indicated within approved plans, structure is independent and a freestanding roof attached to existing home with fasteners.
13) Zoning is requiring roof to meet ordinance requirements and is a requirement to the code.
14) The roof is an improvement to structure to correct an existing violation and is therefore, exempt from substantial improvement requirement for this instance only. Any future improvement or changes to the plan will be subject to review for approval.
15) This project is located within a City of Tucson 100-year floodplain.
16) All work shall conform to the approved details and general Site Plan, which are made part of this permit.
17) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
18) This Floodplain Use Permit is issues concurrently with the improvement plans/permit. Copies of these documents shall be kept in a readily accessible location on site at all times.
19) Any future permanent, freestanding walls or other structures shall have separate floodplain use permit applications submitted to this office for review and approval.
20) An application/processing fee of $50.00 (submittal fee) must accompany each future request for work to be authorized under this floodplain use permit. Engineering study review fees of $150.00 may be imposed based upon the fee schedule in the current floodplain ordinance.
21) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T10OT00609 FOR INFORMATION PLEASE CALL 791-5550."
22) The applicant attests to the fact that the plans and documents submitted represent all of the improvements that will be done to the existing building, and that all addition, improvements or repairs to the building are included in the construction plans and/or documents herewith. No other improvements, repairs, reconstruction, additions or remodeling have been made to the structure that is not indicated in the attached plans and/or documents.
23) Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department Engineering Division. This permit may be renewed for up to one year, at the sole discretion of the City Engineer or designated representatives.
24) This permit is specific to the improvements for 3253 N Sioux Ave, as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit.
25) Contractor will need to call for floodplain use permit inspections by Development Services Department Engineering Division Inspection Team (791-5550) to verify that structure were constructed in compliance with this floodplain use permit.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of approval. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
