Summary of Review
This review is from the Planning and Development Services Department's Engineering Division for the Floodplain Use Permit only. A re-submittal is required. Please include a response letter to the comments detailed below in your next submittal. The site plan review is an engineering review that is related to this review and the comments are, or will be, posted separately under Activity # T10CM00395.

The referenced structure is located within a FEMA Special Flood Hazard Area Zone AE. Structures located in this flood zone must be constructed at an elevation that meets or is higher then the regulatory floodplain elevation. However, this structure was constructed before the City of Tucson was mapped for floodplains, therefore is called a "pre-FIRM" structure. That means that it is "grandfathered in" and is not required to meet the current regulatory elevation. However, there are restrictions on the improvements to the structure discussed below.

It appears this structure is non-conforming because the water surface elevation is higher then grade and the structure is built at grade. That means that the structure's finished floor elevation is likely lower then the regulatory flood elevation. If this is not the case, the structure is conforming and the only restriction to the improvements to the structure would be to build it at the current elevation or higher. This elevation may be verified by providing an elevation certificate completed by an Arizona Registered Land Surveyor of the existing structure.

Please provide us with the current market value of the existing structure and the cost of the improvements to determine if the proposed improvements will satisfy FEMA's floodplain regulations and the City of Tucson's Floodplain Ordinance to approve this permit. Because the structure is pre-FIRM and likely non-conforming the cost of the improvements must not exceed 50% of the current market value of the existing structure. Guidance documents on how to determine the cost of improvements and the current market value are provided.
