This parcel lies in a City Flood Hazard Zone (FIRM map number 040076 C 2239K). The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

Parcel 140-19-010A, 5418 S Park Av, PTN N620' S680' W622.9' E667.90' SE4 NW4 SW4 5.3 AC SEC 06-15-14E, in a portion of Township 15 South, Range 14 East, Section 6,

for the purpose of drainage improvements, and other associated development construction for Blue Sky Subdivision.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 12 conditions apply to permit T10OT00019:
1) Call for Pre-construction meeting, intermediate, and final inspections. For a PDSD Engineering Inspection, call IVR (740-6970), or contact PDSD Engineering at 837-4991, or schedule inspections online at: http://www.ci.tucson.az.us/dsd/Online_Services/Online_Permits/online_permits.html
2) No disturbance in Old Nebraska Wash other than those areas indicated within easements shown on the approved plans.
3) PDSD Engineering Inspections are required prior to SWPPP installation and final floodplain inspection.
4) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T10OT00019. FOR INFORMATION PLEASE CALL 791-5550."
5) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.
6) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
7) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
8) Designated concrete washout locations are required and shall not be located in or near basins or south portion of the parcel in floodplain areas. Location of temporary material or vehicle staging / stockpile area shall be placed within grading limits and not located in any water harvesting or basin areas or floodplain areas. Any wash off area, temporary chemical storage area, temporary refuse area, and / or vehicle storage areas shall be placed in non-floodplain areas and shall have interim stormwater controls installed along downstream side of these areas.. There shall be no wash off area, temporary chemical storage area, temporary refuse area, or other construction storage within the floodplain areas as shown on the plans and as determined by the Drainage Report.
9) All work shall conform to the approved Drainage Report and addenda dated 2-9-10 for Blue Sky Subdivision sealed by Timothy D. Birk P.E., and the approved Grading Plan for Blue Sky Subdivision, sealed by Timothy D. Birk P.E. (dated 2.25.10), and the geotechnical reports and addenda by Pattison-Evanoff Engineering LLC (Project 07-203) which is made part of this permit.
10) Disturbance of the floodplain is only permitted as per the approved construction plans.
11) As-built final grading plans are required to be submitted. The as-builts shall show that the north lots have met minimum grades above the adjacent floodplain in Old Nebraska Wash, as well as inverts for all on-site and off-site drainage structures and channels.
12) See the associated grading plan T09BU01689 and the approved plat S07-085.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire two years from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division.
