FROM: Michael St.Paul: Planning Technician

PROJECT:
T10CM01955
300 South Country Club Road
Garage converted to second unit

TRANSMITTAL: October 18, 2010

COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment.

The site is in the R-1 Zone (LUC Section 2.3.4.2.A.2.). The Development Designator is "H" (LUC Section 3.2.3.1.B). The Perimeter Yard Indicator is AA (LUC Section 3.2.6.4).

This permit application is for a permitted garage that was converted into a three bedroom unit in the rear yard without any permits. (The garage was designed by architect Paul R. Olson and permitted in 1994.)

There is also a carport addition and a garage enclosure on the main house that has not been permitted. An additional permit shall be required for these additions and modifications. (See T10CM02916.)

Parking must all be provided on site for a second dwelling with more than one bedroom. The parking and maneuvering areas must be located in either the side or rear perimeter yard. This "vehicle use area must be improved, which includes surfacing, striping, and provision of barriers, in conformance with Development Standards 3-05.0. Parking spaces may not be located in a vehicular use area in any front street perimeter yard." (LUC Section 3.5.7.1.H)

Alley access or maneuvering directly into or from any parking space is not permitted on a site in which commercial parking standards are required (LUC Section 3.3.7.5).
The following comment is from Traffic:

Due to the arterial status of Country Club Road TDOT-Traffic requires the site to reduce the number of driveways from two access drives to one access drive, or convert one driveway as an ingress only driveway and the second driveway as an egress only driveway.
