Issue -

This is a request by Chad Blunt of Western Land Services, LLC, on behalf of AT&T, to allow a wireless communications tower as a special exception use in the C-2 zone. The special exception site is at 1159 N. Columbus Boulevard, in a self-storage facility northwest of Speedway and Columbus Boulevards. The property is owned by Shurgard Storage Centers, Inc. The preliminary development plan shows a new 65-foot high stealth monopalm, with three sectors of antennas mounted at a center line of 60 feet, and ground equipment, all within an enclosed compound, near the north central portion of the site.

A communications use of this type is subject to Section 3.5.4.20.G.1 of the Land Use Code, and requires approval through a Zoning Examiner Legislative Procedure, Sections 5.4.1 and 5.4.3. A public hearing before the Zoning Examiner is required. The Zoning Examiner will make a recommendation to the Mayor and Council, who will render a decision to grant the use, with or without conditions, or to deny the use.

Surrounding Land Uses and Zoning -

The area surrounding the Speedway/Columbus intersection, in all four directions, is zoned C-2 and developed with miscellaneous commercial uses. The self-storage facility is at the edge of the commercially-zoned area northwest of the intersection. Properties to the north and west are zoned R-2. To the north, across Bellevue, is single- and multi-family residential development, and a small recreational vehicle park. West of and adjacent to the self-storage facility are single-family residences. The closest residential structures are approximately 115 feet to the north and 190 feet to the west of the proposed lease site.

LAND USE PLAN CONSIDERATIONS

Policy Guidance. The site is within the bounds of the Grant-Alvernon Area Plan. That plan and the City's General Plan provide policy guidance applicable to this request. Grant-Alvernon Area Plan Office and Commercial Land Use Policy 2 encourages incorporating appropriate design elements and buffering techniques during the zoning application and associated plan review processes. Policy 6 is to discourage wireless communication antennae arrays unless concealed, disguised, or collocated on existing buildings or structures.

General Plan Policy 3.7 (Element 4) requires that, if possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Visual impacts will be a key consideration during the review process. Policy 4.6 (General Plan, Element 4) promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. Action 5.5A is to consider incentives for telecommunications providers to install infrastructure in older as well as newer neighborhoods, to increase opportunities for all citizens to have access to high-tech telecom services.
Compatibility. The land use plan policies generally support new cell tower proposals that are designed to minimize visual impacts on the surroundings, and if sufficient buffering can be provided. The proposed lease area is within a self-storage facility. At ground level, it will be completely screened from view by the buildings on the site. The lease area is northwest of and adjacent to an approximately 25-foot tall building that has an existing 35-foot tower and antenna on the roof. The faux palm design will conceal the new tower and antenna structures.

Based on a review of aerial photos of the site and surroundings, there are several tall structures in the area. Trees line the perimeter of the storage facility site on the north, west and east sides. There are also several trees in the residential neighborhoods to the north. Most are not palm trees, and they are significantly lower than the proposed 65-foot high stealth monopalm. However, the presence of several trees in the area will help the monopalm blend in, visually.

There are also several power poles in the immediate vicinity, including a few that are approximately 60 feet tall on the south side of Bellevue, which is directly north of the site. There are 35-foot high power poles on the east and west sides of Columbus, and approximately 30-foot high light poles to the east across Columbus, at the car dealership site. The power poles and light poles will help the proposed monopalm blend in with the surroundings.

Neighborhood Concerns -

At the neighborhood meeting in November 2009, which was attended by six neighbors and staff from the Ward 6 office, Garden District neighbors said their neighborhood is a low-income area that is in decline. They asked what AT&T would be willing to do to help the neighborhood. According to the information provided, the neighbors were opposed to this proposal, although no reason was provided. The application further indicated the neighbors' opposition may have been withdrawn after AT&T offered a cash donation to the neighborhood, to be used at their discretion, for neighborhood enhancements.

Summary and Recommendation -

Based on the information provided and staff's assessment, the proposal is consistent with land use plan policies that require mitigating the visual impacts of proposed cell tower facilities. Staff is aware that some neighbors may be opposed to this proposal, however no reason for that opposition has been provided. Staff recommends the following, which will help achieve land use plan policy objectives, as conditions of granting this special exception use:

1) The monopalm components shall be maintained as needed to preserve the visual integrity and stealth characteristic of the monopalm.

2) CMU enclosure walls shall be textured and/or painted to match nearby buildings.

General Plan

Element 2 Policy 3 is to protect established neighborhoods by supporting compatible development. " Supporting Policy 3.9 is to support nonresidential uses, where the scale and intensity of use will be compatible with adjacent uses, including residential development, neighborhood schools and businesses.

Element 4, Supporting Policy 3.7 requires that, whenever possible, telecommunication facilities be located, installed and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and the visual impact of cellular towers will be a prime consideration in the City's acceptance and approval. " Policy 4.6 promotes the coordination of efforts of government, private developers and utility firms to improve the appearance of above-ground utilities and structures. " Policy 5 is to promote neighborhood identity and visual character. " Action 5.5.A is to consider incentives for telecommunications providers to install infrastructure, not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.

PDSD Engineering has no objection or adverse comment to a Special Exception for construction of a 65' monopalm wireless facility, equipment enclosure and related utility work.

The proposed site is located in an existing self-storage facility located at the southwest corner of Columbus Boulevard and Bellevue Street. Columbus Boulevard is an MS&R Collector with an existing right-of-way of sixty feet (60') and a proposed right-of-way of sixty-four feet (64'); Bellevue Street is a local street. Proposed access to the site is via Columbus Boulevard.

Columbus Boulevard was reconstructed in 2005 and pavement cuts are not allowed until March 2010. Based upon the PDP, it appears the only pavement cut will be in the onsite PAAL or to Bellevue Street and these are not affected by the pavement cut moratorium.

The site lies in the Alvernon Wash watershed, a non-designated watershed; detention is not required. The site was not designed with retention storage but, since the location of the communications site is impervious in its present state, no threshold storage will be required. The self-storage site is not within a regulatory floodplain and is unaffected by erosion hazard setbacks.

No conditions are requested.
