Kolb Road is an MS&R Arterial with a proposed right-of-way width of 150 feet. The existing right-of-way exceeds this width due to the additional space necessary for the existing bridge over the railroad. The proposed driveway from Kolb Road is aligned with an existing median opening designed for the intersection of Via Rio Pico/Los Reales Road on the western side of Kolb Road. The proposed communications site is not within a 100-year regulatory floodplain. The adjacent Kolb Road Detention Basin and Julian Wash contain the ponding associated with the detention basin and 100-year discharge of the wash. Due to the proximity to the wash and basin, detention/retention is not required. Although the Julian Wash is a WASH Ordinance watercourse, all proposed site development, as shown on the submitted PDP, is outside of the jurisdictional study area for the WASH Ordinance. Conformance with the provisions of the WASH Ordinance is not required. No conditions are requested. |

Kolb Road. The site is a vacant parcel located southeast of the intersection of Kolb Road and the Union Pacific Railroad Rights-of-Way. The applicant proposes a 150-foot high monopole with a four-tier antenna arrangement. First two tiers for AirCell, top tier at 147 feet with six, eight foot tall antennas, second tier at 136 feet with six, eight foot tall antennas, third tier at 127 feet, end user yet to be determined, and the final fourth tier for Sprint at 110 feet with six, four feet tall antennas. The monopole and ground equipment will be within a 60' by 60' (3600 square feet) area enclosed with an eight foot tall masonry wall. The lease area will have vehicular access from Kolb Road and a parking space for service vehicle. The surrounding lands are vacant with the following zones; to the north across the Union Pacific Railroad is zoned SP, Pima County Specific Plan, to the east is zoned RH, Pima County Rural Homestead, to the south is zoned RH, City of Tucson Rural Homestead, and to the west across Kolb Road is City of Tucson La Estancia PAD-7, a Planned Area Development, a master planned complex with a mix of residential, commercial, and industrial land uses. Land Use Plan Policy Summary Land use policy guidance is provided by the Esmond Station Area Plan (ESAP) and the General Plan. The Esmond Station Area Plan Commercial Policy 2 is to ensure commercial development is compatible with surrounding uses. In addition subpolicy 5 states Kolb Road is a designated controlled access corridor and therefore the proposed development access must conform to the access plan approved for the Kolb Road corridor. Since the Davis-Monthan Air Force Base is located north of the proposed site, ESAP policy direction is to ensure compatibility of new development with existing and future operations of the Davis-Monthan Air Force Base. In addition, it requests new developments are reviewed by Davis-Monthan Air Force Base community planning staff. The General Plan provides a broader guidance for locating wireless communications facilities. Element 4 (Community Character and Design) Policy 3.7 requires that, whenever possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Policy 4.6 is to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary aboveground utility lines and structures Discussion: The proposed telecommunication facility is supported; subject to view sheds and appropriate design and color. Buffering and screening of ground equipment should include a masonry wall and landscape material to mitigate potential negative impacts. The proposed use is compatible with surrounding land uses given that the monopole is to be located in the vicinity of existing vertical structures with proportional heights, such as a railroad overpass, utility service poles, and Interstate-10 light poles. The proposed monopole is designed to be multi-carrier with multiple ground pads, thus reducing the potential of a saturation of singular telecommunication poles in the area. The monopole design of this project and its proposed location is in keeping with the intent of the applicable Plans. The request for a Special Exception to allow a wireless cell tower does not require a plan amendment to the Esmond Station Area Plan. Recommendation: The proposed special exception land use for an unmanned Air Cell wireless communication facility can be supported and is in general compliance with applicable policy and the intent of the Esmond Station Area Plan, the General Plan, and the Design Guidelines Manual. The following special exception conditions are recommended to support applicable policies: 1. Prior to development plan approval the applicant shall provide documentation that Davis-Monthan Air Force Base personnel has received this proposal, and it meets Davis-Monthan Air Force Base criteria, including the proposed height and location of the monopole. " ESAP -Davis-Monthan Air Force Base Policy 1B. and 1C. " GP - Element 4, Community Character and Design, Policy 3.7 2. Prior to development plan approval, applicant to provide documentation that the proposed telecommunication facility meets the required setback (400 ft.) from a designated Gateway Route (Kolb Road). " ESAP - Major Streets and Routes Plan, Policy 3A. " GP - Element 4, Community Character and Design, Policy 3.7 3. Development plan to include four-sided elevations drawn to scale for a masonry wall along the lease perimeters. Perimeter walls to include a ten-foot wide landscape buffer with ground cover planting and canopy trees. Landscape area to include an automatic drip irrigation system. Or, in lieu of a landscape buffer along the perimeters of the lease area, the applicant may provide proof, if applicable, that the existing native landscape material is adequate in density, height and health to buffer and therefore soften the mechanical look of the site. The option of using existing native vegetation as the required landscaping, shall require temporary fencing to be in place to protect such vegetation during grading if required, and or prior to construction of site. Temporary fencing not to be removed until after completion of masonry wall. " ESAP - Commercial Policy 2, and SubPolicy 5 " GP - Element 4, Community Character and Design, Policy 3 " DG - Design Context and Neighborhood Character (I.B.2.e) 4. Prior to development plan approval, applicant shall include as a general note the information provided on attached letter dated June 23, 2009, which pertains to the Julian Wash. " ESAP - Commercial Policy 2 " GP - Element 4, Community Character and Design, Policy 3 _____________________________________________________________________________ ADOPTED PLAN POLICY Esmond Station Area Plan: Commercial Policy 2: Ensure commercial development is compatible with surrounding uses. Subpolicy 5. If development is proposed on a designated controlled access corridor (initially Kolb Road, Valencia Road, and Houghton Road), then access must be designed in conformance with access plans approved for the corridor. DAVIS-MONTHAN AIR FORCE BASE Policy 1: Ensure compatibility of new development with existing and future operation of Davis-Monthan Air Force Base. B. Request Davis-Monthan Air Force Base Community Planning staff to review development plans proposed in the Esmond Station area. C. When proposed development is affected by Davis-Monthan Air Force Base operations, require a "fair disclosure statement" be part of any development plans, final plats, informational brochures, and sales/rental agreements, indicating that certain types of military air and ground training activities occur at Davis-Monthan Air Force Base. Policy 3: Provide a street system as identified in the Major Streets and Routes Plan. A. Ensure implementation of Major Streets and Routes Plan policies in street design and gateway design standards for development along the routes so designated. General Plan: Element 4: Community Character and Design Policy 3: Preserve scenic view of natural features and community landmarks 3.7 Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and visual impact of cellular towers will be prime consideration in the City's acceptance and approval. The purpose of this application is to allow for a wireless telecommunication tower and related equipment. This site is within the Tucson International Airport public disclosure area and traffic pattern airspace. The site is also within the City of Tucson Airport Environs Zone, however applicable sections of this ordinance relate to the Davis-Monthan Air Force Base. The Tucson Airport Authority requests the following condition of approval: "That prior to the City's approval of any building permit, the property owner shall record a disclosure statement. The disclosure statement recognizes the existence, and operational characteristics of the Tucson International Airport and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided, which have been reviewed and approved by the City Attorney." Kolb Road. The project includes installation of a wireless cell tower and ground equipment. A review of the Pima County records shows that the project area has been previously surveyed (1996-361.ASM) for cultural resources. No archaeological or historic sites were identified as a result of this survey. Recommendations: COT and the developer should be aware of the cultural resources sensitivity of the proposed development property and appropriate measures should be taken before any ground-disturbing construction occurs. In this case, cultural resources survey would not be recommended to identify any significant cultural or historic resources that may be present, but visual impacts may be considered. Once development construction commences, Arizona state laws protecting cultural resources and human remains should be enforced. In the event that human remains, including human skeletal remains, cremations, and/or ceremonial objects and funerary objects are found during excavation or construction, ground-disturbing activities must cease in the immediate vicinity of the discovery. State Laws ARS 41-865 and/or ARS 41-844 require that the Arizona State Museum be notified of the discovery at (520) 621-4795 so that appropriate arrangements can be made for the repatriation and reburial of the remains by cultural groups who claim cultural or religious affinity to them. The human remains will be removed from the site by a professional archaeologist pending consultation and review by the Arizona State Museum and the concerned cultural groups. Sherry A. The approximate distance of the proposed cell tower from the end of the runway is 14,987 feet. Using the formula in the Land Use Code (14,987 feet/60:1 ratio) it will allow a tower to built up to a maximum height of 249.78 feet. However, the established elevation of the cell tower site is 2,806.9 feet compared to the elevation at the runway end of 2,705 feet. The difference between the site elevation and the runway elevation is an increase of 100.9 feet (2,806.9 minus 2705 ). This difference is subtracted from the allowable 249.78 feet (249.78-101.9) and allows a new structure to be built at a total height of 147.88 feet. Therefore, it appears that the new 150 foot proposed cell tower would penetrate the allowable height as described in Section 2.8.5.9 of the Airport Environs Zone. So the allowable max. height is 147.88' compared to their proposed 150' tower. Please call me at your convenience (I will be out of the office from 20-28 Aug). I'd like to offer up for you a couple of options the proponent might want to consider to mitigate the problem. Thanks, Darren T.
