1. The proposed use falls under the LUC Sec. 2.2.2.3 Special Exception Land Uses, Commercial Services Use Group, Sec. 6.3.5. Communications "25", limited to wireless communication towers and antennae, subject to: Sec. 3.5.4.20.B, .C, and .E.2, or Sec. 3.5.4.20.B, .C, and .F.1, or Sec. 3.5.4.20.B, .C, and .G
2. Clearly indicate how the proposed new 150' in height cell tower at this address will meet the following code requirements.
a. Sec. 3.5.4.20.G.b. New towers require a minimum separation of one (1) mile from any existing tower, regardless of ownership, unless documentation establishes that no practical alternative exists.
b. Sec. 3.5.4.20.G.c. All appropriate measures shall be taken to conceal or disguise the tower and antenna from external view.

3. Clearly indicate how the proposed 8' CMU wall and the proposed structures will meet the setback requirement of 4 times the wall height from the east property line. A Design Development Option (DDO) may be required to be completed and approved to reduce the required setbacks.

This Special Exception request is to allow a new cellular communications (collocation) monopole facility at 7501 S. Kolb Road. The lease site is located east of Kolb Road and south of the Union Pacific Railroad Rights-of-Way. The applicant proposes a 150-foot high monopole with a four-tier antenna arrangement. First two tiers for AirCell, top tier at 147 feet with six, eight foot tall antennas, second tier at 136 feet with six, eight foot tall antennas, third tier at 127 feet, end user yet to be determined, fourth and final tier for Sprint at 110 feet with six, four feet tall antennas. The monopole and ground equipment will be within a 60' by 60' (3600 square feet) area enclosed with an eight foot tall masonry wall.

The surrounding lands are vacant with the following zones; to the north across the Union Pacific Railroad is zoned SP, Pima County Specific Plan, to the east is zoned RH, Pima County Rural Homestead, to the south is zoned RH, City of Tucson Rural Homestead, and to the west across Kolb Road is City of Tucson La Estancia PAD-7, a Planned Area Development, a master planned project with a mix of residential, commercial, and industrial land uses.

B. Request Davis-Monthan Air Force Base Community Planning staff to review development plans proposed in the Esmond Station area.
C. When proposed development is affected by Davis-Monthan Air Force Base operations, require a "fair disclosure statement" be part of any development plans, final plats, informational brochures, and sales/rental agreements, indicating that certain types of military air and ground training activities occur at Davis-Monthan Air Force Base.

3.7 Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and visual impact of cellular towers will be prime consideration in the City's acceptance and approval.
5.5.A Consider incentive for telecommunications providers to install infrastructure, not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.

Design Guidelines Manual

e. Design Context and Neighborhood Character (1.B.2.e)
Intent - Improve the character of new projects and reinforce existing architectural character in established neighborhoods.

Solution - Harmonize new buildings with existing buildings by incorporating design elements of the adjacent architecture including the following:
" Scale and massing of structure
" Finishes, materials, and colors
" Site amenities such as walls and landscaping

Assessment:
These Plans support the requested land use, subject to view sheds and appropriate design and color. Ground equipment to be screened with a masonry wall and buffered with landscape material to mitigate potential negative impacts. The proposed monopole is to be located adjacent to an arterial street, railroad tracks, and a Kolb Road overpass for the railroad line. It appears to be compatible with the existing vertical heights the adjacent railroad overpass, Interstate-10 light poles, and existing utility service poles. The proposed monopole is designed to be multi-carrier with multiple ground pads, thus reducing the potential of a saturation of singular telecommunication poles in the area. The monopole design of this project and its proposed location is in keeping with the intent of the applicable Plans.
A plan amendment is not required.

Discussion:
The applicant attended a pre-submittal meeting with staff on May 13, 2009 and held a neighborhood meeting on June 9, 2009. One attendee signed in, he represented the Rita Ranch Association and did not support the telecommunication facility due to height and potential visibility from the Rita Ranch community. Sufficient information has been provided to demonstrate general compliance (*See Staff Recommendations), with the Esmond Station Area Plan, and the General Plan.


Recommendation:
(*) Staff recommends acceptance of this application for full review with the following criteria to be addressed by the applicant prior to the full review submittal:

1. Prior to full review by staff, applicant to provide documentation the monopole meets any height restriction imposed by the Davis-Monthan Airforce Base Approach-Departure, Overlay Zone.
2. Prior to full review by DSD staff, applicant to provide documentation the appropriate Davis-Monthan Airforce Base personal has received this submittal.
3. Prior to full review by staff, applicant to document the proposed telecommunication facility meets the required setback (400 ft.) from a designated Gateway Route (Kolb Road).
4. In lieu of a landscape buffer around the lease area, the applicant to document existing native landscape material is adequate to soften the mechanical look of the site.
5. Prior to full review, applicant to transfer the information provided on attached letter dated June 23, 2009, which pertains to the Julian Wash. Please superimpose on the preliminary development plan/site plan, the Julian Wash floodplains and top of banks.
