This Special Exception request is to allow the collocation of a 6' (diameter) microwave dish at the 56-foot level of an existing 150-foot communications monopole located at 2721 East Benson Highway. The monopole sits on a vacant C-2 lot and is surrounded by C-2 zoning on all sides except the northeast side of the site, which abuts R-2 zoning. The Kino Area Plan (KAP) provides guidance for this land use request along with the General Plan, and Design Guidelines.

Policy Summary
KAP commercial subgoal, is to provide for an adequate amount and appropriate arrangement of commercial development within Kino. Policy 1.c. is to encourage private developers to utilize existing provisions in the Land Use Code which allow the integration of appropriate commercial and supportive service activities within industrial parks.

The General Plan states within Element #4, Community Character and Design, under Policy 3.7 that whenever possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Also under Policy 4.6 states to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary aboveground utility lines and structures.

The Plans support the requested land use when stealth design elements are used to minimize visual impacts in conjunction with adequate buffering to mitigate the potential negative impacts of more intense development on established neighborhoods are employed.

Discussion

This Special Exception request is to allow the collocation of a 6' (diameter) microwave dish at the 56-foot level of an existing 150-foot communications monopole located on a vacant, commercially zoned parcel at 2721 East Benson Highway. Vacant R-2 zoning abuts the site on the northeast side and the rest is surrounded by C-2.

The Kino Area Plan does not specifically address communication antennas; however, the General Plan supports communication pole requests when visual impacts are minimized. No stealth techniques are proposed for this location. The only positive reduction in visual clutter results from co-location on an existing facility and by painting the microwave dish to match the existing monopole. It is also anticipated the microwave dish will have a negligible visual impact in the towers, as a result of the size and mass of the existing arrays.
Recommendation

The proposed special exception can be supported and is in general compliance with applicable policy and the intent of the Kino Area Plan the General Plan, and the Design Guidelines Manual. The following special exception conditions are recommended to support applicable policies.


1. The proposed collocation of the 6-foot (dia.) microwave dish shall be located no higher than 56' at ground level.

Plan Policy

Kino Area Plan
Overall Goal

To establish guidelines for the future growth of the Kino area and to provide a balance of uses and a wide range of activities, including employment, shopping, housing, and recreation.

Commercial

Commercial development is an important part of any community and can contribute to an attractive and convenient living environment. Kino is in the unique position of providing for various commercial needs. On a regional level, it will continue to fulfill a tourist-oriented commercial function. In addition, commercial activity will increase to meet the supportive service needs of in-coming industrial employers/employees Demand for increased neighborhood-oriented shopping facilities will continue as a result of increased residential development.

Such commercial functions should be arranged to best serve the needs of the neighborhood, community and region and should be encouraged to occur within an activity center framework where possible. Some land originally designated for commercial uses may be considered more appropriate for other uses due to changing area needs and trends.

SUB-GOAL:

Provide for an adequate amount and appropriate arrangement of commercial development within Kino.

POLICY 1: The City should promote a variety of commercial activity centers within Kino to accommodate future regional, community, and neighborhood commercial needs (GP, Section 11, Policy 5 & 7A, B, C). This can be accomplished by:

c. Encouraging private developers to utilize existing provisions in the Land Use Code which allow the integration of appropriate commercial and supportive service activities within industrial parks.

3.7 Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and visual impact of cellular towers will be prime consideration in the City's acceptance and approval.

Policy 5: Promote neighborhood identity and visual character

5.5 Promote upgrades to neighborhood infrastructure, including sidewalks and street lighting, and improvements to the existing housing stock.

5.5.A Consider incentive for telecommunications providers to install infrastructure, not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services.

Design Guidelines Manual

Intent - Improve the character of new projects and reinforce existing architectural character in established neighborhoods.

Solution - Harmonize new buildings with existing buildings by incorporating design elements of the adjacent architecture including the following:

05/29/2009 MATT FLICK ENGINEERING REVIEW Completed DSD Engineering has no objection or adverse comment to approval of the Special Exception for the microwave antenna to be mounted on an existing 150' tower located at 2721 E Benson Highway.

The site lies along the northern side of Benson Highway. Benson Highway is designated as an MS&R Arterial with a proposed right-of-way of 120'; existing right-of-way is 150'. The eastbound and westbound travel lanes are divided by a raised median. 2-12' travel lanes and a 10' multi-purpose lane front this site. There is no sidewalk or curbing along the parcel frontage although both exist west of this parcel. Benson Highway is signed at 45 mph. There is no bus service along this section of Benson Highway and no RTA improvements are planned for this stretch of Benson Highway.

The site does not lie within a mapped floodplain. Although the site lies within the Earp Wash critical basin, the proposed improvements will have little to no effect on the drainage and detention/retention is not required. Soils are Hydrologic Type B and have moderate infiltration.

Thank you for the opportunity to comment on SE-09-10 Verizon - Benson Highway, a special exception application for a site located southeast of the corner of Arlington and Benson Hwy. The site is currently zoned C-2. The purpose of this application is to allow for a wireless telecommunication collocation.

This site is within the Tucson International Airport public disclosure area and traffic pattern airspace. The site is not within the City of Tucson Airport Environs Zone.

The Tucson Airport Authority requests the following condition of
rezoning approval:

"That prior to the City's approval of any building permit, the property owner shall record a disclosure statement. The disclosure statement recognizes the existence, and operational characteristics of the Tucson International Airport and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided, which have been reviewed and approved by the City Attorney."

The Tucson Airport Authority also asks that the property owner forward a copy of the recorded airport disclosure statement to:
