TRANSMITTAL DATE: December 15, 2009

1. This plan was reviewed for compliance with the requirements for parking striping and pedestrian access and to bring the site into compliance with the previously approved site plan. Please address the following items and resubmit the site plan for review.

2. Relocate the sidewalk to provide a more direct location. See redlines for optional location. The parking spaces will have to be relocated or shifted to allow the sidewalk to be placed in a location that is more in line with the location the pedestrian will be led to.

3. As part of this review a site inspection was done. As part of the inspection it was noted that an expansion of land area has been made to the east of the existing Recycling center. This area of land has not been approved for an expansion and no records could be found of any permits for the storage use. Prior to approval of the proposed restriping the plan must include the expansion and address the requirement that are applicable to this new expansion which include but is not limited to, paving, landscaping, screening.

It is also my understanding that the owner Gary Kippur was provided with a Zoning Administrator letter of determination related to the use and how the site was understood to function as it relates screening and storage. This may be an item that the new Zoning Administrator will have to address. While it appears that the expansion does not involve much vehicular use area there is a requirement however, to provide some method of dust control. Also according to Mr. Kippur did explain how the letter of determination was finally provided, unfortunately I was not around when this letter was issued so I am not completely clear on how this will affect the expansion. This will probably have to be addressed by the current zoning administrator Craig Gross.
