RESUBMITTAL REQUIRED: Grading Plan and SWPPP

The Grading Plan (GP) and Stormwater Pollution Prevention Plan cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Grading Plan:
1. Please include a response letter to the comments along with the corrected copies of the GP.
2. As per the Federal ADA requirements, all wheel chair ramps shall have the truncated domes instead of the standard grooves that are shown on COT SD 207. Aside from the Truncated Domes, all wheel chair ramps shall be constructed in accordance with COT SD 207.
3. Add note: "Depress all landscaped areas a maximum of 6" for water harvesting"
4. Add the following notes to the grading plan notes:
" "The approved Grading Plan is the only acceptable construction plan onsite. The Contractor may not use any other plans, such as the approved Tentative Plat and/or Development Plan, for construction purposes. The Contractor may ask the Development Services Inspector to consult with the other approved plans for additional information or details that might not be included on the approved grading plan but needed for completion of work."

" "Any engineering work to be done below grade (i.e. toe-downs, cutoff walls, drainage pipes/structures, etc.) shall not be back filled until Development Services Inspector inspects the work and approves it."

5. List administrative address/site address on plans.
6. List subdivision number (S08-070 & S05-252) on the plans.
7. Show all symbols in the legend. Where is LWH called out on the plans.
8. Edit note no. 9 to "All grading shall conform to City of Tucson DS 11.01.0, Excavating and Grading".
9. Special Grading Notes:
1. Show Gradeable area.
2. Show limits of grading.
10. A permit or a private improvement agreement might be necessary for any work performed within the Right-of-way. Contact Permits and Codes at (520) 791-5100 for permit information
11. Show top of banks (20 ft. maintenance easement - 50 ft. study area). The line can barely be seen on the reproduction. Perhaps a different line weight would work, i.e., not shaded.
12. Call out the names of all washes.
13. Show the 100-year flood peak discharge.
14. Cut or fill slopes require a 2' minimum setback from property line.
15. Concrete headers are required at the curb returns.
16. Drainage patterns with percent slopes (Show patterns within the first 100 feet from the property line).
17. Flow arrows, grades and flow rates within and adjacent to site to show drainage scheme.
18. Call out peak discharges entering and exiting the site.

Drainage report:
1. The DR has been accepted by engineering.

Stormwater Pollution Prevention Plan:

1. Show the concrete wash-out area on the site map.
2. Show the construction entrance area on the site map.
3. There are numerous spelling errors in the SWPPP. Use spell or another program to correct these mistakes.
4. Use arrows to show the direction(s) where stormwater will flow for all areas within the project limits (This is for the period during construction, not final contours. Flow direction may change as project grading progresses; when this occurs, maps are to be updated.). Part III.C.3.a.
5. Show areas of soil disturbance and areas that will not be disturbed. Part III.C.3.b.
ADMINISTRATIVE:
6. Ensure the SWPPP is signed by a person meeting the certification requirements of Permit Part VIII.J. Part III.A.3, Part VIII.J.2.
7. Include a copy of AZPDES permit (AZG2008-001) with the SWPPP. Part III.D.1.
8. Include a copy of the completed NOI form that was submitted to ADEQ. Part III.D.2.
9. Include a copy of the authorization certificate received from ADEQ. Part III.D.3.
10. Identify any city or county which received a copy of the authorization certificate. Part III.D.4.
11. Any reference to the permit shall be from the current General Permit No. AZG2008-001. Change any reference from permit no.AZG2003-001.
12. Add a note stating that the operator(s) shall report to ADEQ any noncompliance (including spills) which may endanger human health or the environment. The operator shall orally notify the office listed below within 24 hours:

Signature Requirements
13. Include a certification and signature for each operator in accordance with Part VII.K. (Part IV.J.1).
14. All NOIs must be signed and certified as follows:
a) For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer means:
i) A president, secretary, treasurer, or vice-president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision-making functions for the corporation; or
ii) The manager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of the regulated facility including having the explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
b) For a partnership or sole proprietorship: By a general partner or the proprietor, respectively; or
c) For a municipality, state, federal, or other public agency: By either a principal executive officer or ranking elected official. For purposes of this section, a principal executive officer of a Federal agency is the chief executive officer having responsibility for the overall operations of a principal geographic unit of the agency (e.g. Regional Administrators of EPA).
15. Reports and Other Information: All NOTs, SWPPPs, reports, certifications, or information required by this general permit and other information requested by the ADEQ or authorized representative of the ADEQ shall be signed by a person described in Part VI.K.1 or by a duly authorized representative of that person. A person is a duly authorized representative only if:
d) The authorization is made in writing by a person described in Part VII.K.1;
e) The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity, such as the position of manager, operator, superintendent, or position of equivalent responsibility or an individual or position having overall responsibility for environmental matters for the operator. (A "duly authorized representative" may be either a named individual or any individual occupying a named position.); and
f) The signed and dated written authorization is included in the SWPPP and submitted to the ADEQ upon request.
16. Certification. Any person signing a documents under the terms of this permit shall make the following certification: I certify under penalty of law, that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations.

Comments:

1. The grading plan has been reviewed by Zoning Review Section but cannot approve the plan at this time.

2. While zoning acknowledges that the grading plan is in substantial zoning compliance as it relates to the Zoning review purview, with the unapproved version of the Final Plat/development plan, the grading plan cannot be approved at this time. All engineering and Landscape comments must be addressed before zoning can approve the plan. Due to any changes needed to the grading plan as a result of the other agency comments zoning must re-review the grading plan on the next submittal to ensure zoning compliance has not been adversely affected.

3. Please ensure that the grading plan continues to match the CDRC approved and stamped final plat/development plan unless changes requested by other agencies affect the development plan. A revised development plan may be required to ensure zoning compliance is met.

Additional comments may be forthcoming based on any revisions made to the plan.

2) Add the following note to the grading plan:
Temporary fencing is required during construction to protect areas not covered by the NPP Plan. The area to be fenced shall be beyond the "drip-line" of the vegetation by one-half (½) the distance of the "drip-line" radius. DS 2-15.6.0 & DS 2-06 Figure 1.

3) Revise the Grading Plan to remove indications of grading or development beyond the grading limits. LUC 3.8.4.2
