Broadway Boulevard, zoned C-1. The proposed antennae for the communications facility will be mounted on a new 70-foot tall stealth monopalm. The associated equipment cabinets will be located inside the existing office building in a 257 square foot leased area. The actual siting of the proposed 70-foot high monopalm is at the north side of the existing office building. The subject site is bounded by C-1 zoning to east and west, C-1 zoning across Broadway to the south, and R-2 zoning to the north. The General Plan (GP) and the Sam Hughes Neighborhood Plan (SHNP) provide land use guidance for the subject parcel. Policy Summary SHNP Land Use, Goal 1, Policy 1.2. - Broadway Frontage, is to allow general commercial uses provided new developments furnish required access, off-street parking, and circulation which will not be eliminated or adversely affected by future dedications for, and construction of, any projects recommended by the Broadway Corridor Study. The GP states within Element #4, Community Character and Design, under Policy 3.7 that whenever possible, telecommunications facilities be located, installed and maintained to minimize visual impacts and preserve views. Also under Policy 4.6 the GP states to promote the coordination of efforts of government, private developers, and utility firms to improve the appearance of necessary aboveground utility lines and structures The proposed monopole will be disguised as a palm tree and will be located within a developed office commercial site zoned C-1. The Plans support the requested land use when visual appropriate design elements and buffering techniques to mitigate the potential negative impacts of more intense development on established neighborhoods are employed. The proposed wireless communication facility responds to the characteristics of the natural landscape of the surrounding area, as the communications tower will be stealth in the form of a palm tree. As such, the project is in general compliance in keeping with the intent of these Plans and a plan amendment is not required. Discussion This site is a reasonable fit for the proposed telecommunications facility, as it is not readily visible to the general public and will be stealth designed in the form of a monopalm. Although Broadway Boulevard is a Gateway Route, the actual siting of the monopalm is on the north side of the property away from Broadway Boulevard. The antennas will be concealed within the branch canopy of the tree, and bark cladding will be placed on the vertical structure to authenticate the appearance of the trunk. There are about 25 existing palm trees of varying heights around the proposed site. The associated equipment cabinets will be located inside the existing office building in a 257 square foot leased area. The second wireless carrier will also be painted to match the trunk of the monopalm. The General Plan and the Sam Hughes Neighborhood Plan support development that is designed to be compatible with and sensitive to surrounding land uses. The proposed telecommunications facility appears to have been reasonably designed to blend in with the surroundings, and therefore, does not conflict with Plan policies. Recommendation The proposed special exception land use for the installation of an unmanned AT&T T Mobile wireless communications located on a commercial office site at 2919 E. Broadway Boulevard, can be supported and is consistent with the policy and intent of the General Plan and the Sam Hughes Neighborhood Plan. The following conditions are recommended to further the proposal's compliance with the General Plan and the Sam Hughes Neighborhood Plan policies: 1) The monopole will be stealth designed in the form of a palm tree and the antennas will be concealed within the branch canopy of the tree. Bark cladding will be placed on the vertical structure to authenticate the appearance of the trunk. In order to accomplish this goal, it is proposed that the following actions be taken: Policy 1: Discourage rezoning of land which would allow densities higher than currently permitted under the existing R-1 zoning classification, except for those lots which access onto Speedway Boulevard and Broadway and at the intersections of Sixth Street and Tucson Boulevard and Sixth Street and Campbell Avenue. See Map 4 for proposed commercial node areas. 2. Broadway Frontage. General commercial uses are appropriate provided new developments furnish required access, off-street parking, and circulation which will not be eliminated or adversely affected by future dedications for, and construction of, any projects recommended by the Broadway Corridor Study. Policy 2: Preserve the unique diversity and character of the neighborhood's historic and architectural value. General Plan Element 4: Community Character and Design Policy 3. Preserve scenic views of natural features and community landmarks 3.7 Require that, whenever possible, telecommunications facilities be located, installed, and maintained to minimize visual impact, preserve views, and be consistent with the City's adopted land use plans and policies. Cabling and fiber optics should be installed underground where possible, and visual impact of cellular towers will be prime consideration in the City's acceptance and approval. Policy 5. Promote neighborhood identity and visual character 5.5.A Consider incentive for telecommunications providers to install infrastructure, not only in newer areas, but also in older neighborhoods to increase opportunities for all citizens to have access to high-tech telecom services. Design Guidelines Manual e. Design Context and Neighborhood Character (1.B.2.e) intent - improve the character of new projects and reinforce existing architectural character in established neighborhoods. Solution - harmonize new buildings with existing buildings by incorporating design elements of the adjacent architecture including the following: · Scale and massing of structure · Finishes, materials and colors · Site amenities such as walls and landscaping f. Landscape Screens (I.B.3.f) Intent - Use landscape. Grading, and walls to screen less visually attractive uses. Solutions - screen dumpster areas, outside storage, utility, and other free-standing equipment and water pumping stations by integrating them with the design and materials of the principal structure. PLANNING DIVISION The Planning Division has no comments or objections to the proposed cellular phone tower. Distribution to pertinent departments within the county garnered comments from the Cultural Resources Department only. Those comments are as follows: CULTURAL RESOURCES DEPARTMENT REPORT COT and the developer should be aware of the cultural resources sensitivity of the proposed development property and appropriate measures should be taken before any ground-disturbing construction occurs. Although, in this case, cultural resources survey would not be recommended to identify any significant cultural or historic resources that may be present, visual impacts to adjacent cultural resources may be considered. However, once development construction commences, Arizona state laws protecting cultural resources and human remains should be enforced. In the event that human remains, including human skeletal remains, cremations, and/or ceremonial objects and funerary objects are found during excavation or construction, ground-disturbing activities must cease in the immediate vicinity of the discovery. State Laws ARS 41-865 and/or ARS 41-844 require that the Arizona State Museum be notified of the discovery at (520) 621-4795 so that appropriate arrangements can be made for the repatriation and reburial of the remains by cultural groups who claim cultural or religious affinity to them. The human remains will be removed from the site by a professional archaeologist pending consultation and review by the Arizona State Museum and the concerned cultural groups.
