SUMMARY: Engineering Division of Development Services Department has received and reviewed the Floodplain Use Permit, Drainage Statement (Bogardus Engineering LLC, 06OCT08) and the Environmental Resource Report (Presidio Engineering, Inc., 10OCT08) for the above referenced property and does not recommend approval of the Floodplain Use Permit at this time. Please provide the following for further review:

1. Prior to Floodplain Use Permit approval a private access, maintenance and construction easement is required for the portion of the proposed 30-inch reinforced concrete pipe that extends into the public right-of-way of the Rodeo Wash. All work within the public right-of-way will require a separate easement, with recordation information, from the City of Tucson Real Estate Department and/or City of Tucson Department of Transportation prior to Floodplain Use Permit approval.

2. Provide a signed, notarized approval letter from the adjacent property owner (Lot 1) which is required for the proposed drainage improvement (30-inch RCP) that crosses the access road for Lot 1 (Wal-Mart). Since the proposed culvert is for Lots 2, 3, and 4 and the proposed easements are dependant upon Final Plat approval a signed, notarized agreement is required to construct the culvert on adjacent property prior to the recordation of the easement on private property.

3. The Drainage Statement was reviewed and approved for the proposed 30-inch RCP only. The report was not reviewed nor approved for detention/retention requirements for Lots 2, 3 or 4. Per the proposed report the Wal-Mart site is currently accepting flows and providing the required detention/retention requirements for Lots 2, 3 and 4 for existing conditions, however once these lots are developed and flow is no longer allowed to flow across Wal-Mart's lot then Lots 2, 3 and 4 will be required to provided a separate basin or separate common basin to show conformance with DS Sec.10-01 for detention/retention requirements.

4. Be advised that the Final Plat (S07-158) will be required to provide a note that states; "A separate Development Plan and Drainage Report (detention/retention requirements) will be required for Lots 2, 3 and 4 when they come in for development." This note should have been on the Tentative Plat; however the Final Plat will be required to show this.

5. Provide a separate note on the 1st sheet of the proposed plan set to state; "Call for a Pre-construction meeting prior to start of earthwork. 6. Approval from TDOT Permits and Codes for all improvements within the public right-of-way will be required. A right-of-way use permit application will be required prior to construction. GENERAL COMMENTS:

Please provide a revised plan set, notarized letter of approval and the private easement with recordation information for review and approval that address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
