This site is located in the R-1 Zone (LUC Section 2.3.4.2.A.1). The Development Designator is "G" (LUC Section 3.2.3.1.B) and the Perimeter Yard Indicator is AA (LUC Section 3.2.6.4). Revise the delineated dimensioned setback for the front property line. The required setback is the greater of one and one-half (1 1/2) times the height of the structure's wall facing the front property line or twenty feet (20'-0") measured from the front property line to the front of the structure (LUC Section 3.2.6.5.A). Provide a shared maintenance agreement for the wall that crosses into the adjacent property of Lot #253. Also provide written permission from the owner's of Harrison Hills Lot 253 for the placement of the wall within their property. A ROW use permit and a revocable easement are required for the portion of the wall that extends into the front ROW. The concrete ramp into the alley right-of-way (ROW) requires a ROW use permit and a revocable easement or it must be removed. A permit is required for the pool. COMMENTS: the following comments are relative to an application for a Design Development Option (DDO). The minimum setback distance from any structure to the side street perimeter yard is ten feet (10'-0") (LUC Section 3.2.6.5.A). The proposed setback expends into the ROW by as much as six inches (6"). The purchase of a portion of the ROW shall be required to provide for a proposed zero setback. The minimum setback along an interior lot line is the greater of six (6) feet or two-thirds (2/3) the structure's height. Six feet is required and five (5) inches is proposed. |
