FLOODPLAIN USE PERMIT # T08OT02278
PROJECT ADDRESS: 8750 E Woodland Rd, Tucson AZ 85749
APPLICANT'S NAME: Platosa LLC Attn: Peter Megaw
PROPERTY OWNER: Platosa LLC

This parcel is located within in a FEMA Floodway and a Special Flood Hazard Area (SFHA), Zone AE as shown on the Flood Insurance Rate Map (FIRM), Community-Panel No. 040076 C 1670K, effective date February 8, 1999 with LOMR dated 24JUL00. The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

8750 E Woodland Rd Tucson, AZ 85749; TANQUE VERDE COUNTRY ESTATES LOT 21 &
PTN NW4 NW4 LYG SLY & ADJ SEC 3-14-15. For the purpose of constructing a 3,720 SF Horse Barn, 3,800 SF Horse stalls, 4-storage sheds, expanded riding arena, and replacement of 2- 5,000 gallon water tanks.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 15 conditions apply to this permit:

1) This permit becomes invalid and is subject to additional floodplain review, if any required development changes or deviates from the approved plans, or, if there is any further disturbance within the floodplain and floodway of the Tanque Verde other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from the construction of a 3,720 SF Horse Barn, 3,800 SF Horse stalls, 4-storage sheds, expanded riding arena and replacement of 2- 5,000 gallon water tanks within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
2) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
3) All work shall conform to the approved general site plan sheets and details for the construction of the 3,720 SF Horse Barn, 3,800 SF Horse stalls, 4-storage sheds, expanded riding arena and replacement of 2- 5,000 gallon water tanks, prepared by Richard Macias, dated 03FEB09 and the structural building plan sheets for both structures, which are made part of this permit.
4) This FUP is for constructing/improvements within a regulatory floodway and SFHA Zone AE per FIRM Panel #1670K. The City of Tucson recommends approval of the improvements based on the submitted Civil Drainage Report showing no-rise and no encroachment. The Community (City of Tucson) based this approval on the submitted professional civil report and the provided calculations from the civil engineer.
5) 2 Elevation Certificates (prior to slab and prior to final) are required for the 3,720 SF L-Shaped Barn to verify that the concrete floor of the barn is constructed per the FFE shown on the site plan. The elevation certificates are required by FEMA/NFIP for both the FFE and the openings (vents), this is a Federal Floodplain and the elevation certificates are a FEMA document required for all FFE and venting purposes. The ELCERTs also help to verify that, 1- there is no excess fill brought in to elevate the FFE (would prevent an encroachment that is not shown in the report or on plan) and 2- to verify that the openings are constructed per drawing.
6) The proposed 3,800 SF Horse Stalls are to remain open sided and must allow floodwaters to pass through unobstructed.
7) The proposed 2- 5,000 gallon tanks and 4 storage sheds must be securely anchored to prevent flotation.
8) The expansion of the riding arena can not disturb areas outside of the proposed grading limits. The riding arena must be constructed to allow floodwaters to infiltrate into the soil, i.e. can not be compacted or constructed with impervious material.
9) New electrical equipment is not allowed or permitted under this Floodplain Use Permit. Future improvements will require a separate Floodplain Use Permit and all new electrical junctions, boxes, A/C units, Evaporative Coolers, hot water heaters, etc will be required to be certified by a registered land surveyor verifying that the new electrical equipment is elevated at or above the calculated water surface elevation as shown on an Elevation Certificate to show that it is in conformance with the rules and regulations of Chapter 26 of the Tucson Municipal Code and Chapter 44 of the Code of Federal Regulations.
10) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T08OT02272 FOR INFORMATION PLEASE CALL 791-5550."
11) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.
12) Any additional future disturbance of the floodplain and floodway shall have separate floodplain use permit applications submitted to this office for review and approval.
13) There shall be no stockpiling material, or storage of vehicles, there shall be no stockpiling or disturbance outside of disturbance limits. Construction material and vehicles shall be promptly removed once installation and construction is complete.
14) Per Record research all past permits have been finalized and all conditions have been addressed. The Floodplain Use Permit #502 had been revised in 1998 to eliminate the proposed guesthouse and the requirement for the Elevation Certificate was voided per the engineering reviewer, Frank Sousa. The review became a substantial improvement review and the applicant showed under #502 that the improvements were valued under the 50% threshold. No further action is required for these permits.
15) See the associated activities T08CM03103 and T08CM03104.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
