2. While zoning acknowledges that the grading plan is in substantial zoning compliance as it relates to the zoning review purview, with the unapproved version of the site plan, the grading plan cannot be approved at this time. Please review the grading plan and compare it to the most current version of the site plan to ensure accuracy and to ensure that any revisions that have been made to the site plan after the grading plan was submitted are incorporated or addressed in the grading plan addressed.

3. Two copies of the DSD approved and stamped site, landscape/NPPO plans must be included with the next grading plan package. RESUBMITTAL REQUIRED: Grading Plan, Drainage Report and SWPPP

The Grading Plan (GP), Drainage Report (DR) and Stormwater Pollution Prevention Plan cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Grading Plan:
1. Please include a response letter to the comments along with the corrected copies of the GP.
2. The GP cannot be approved prior to the Site plan.
3. Access to the loading space through basin does not function as is per Land Use Codes: 3.3.7.5 Use of Street or Alley for Maneuvering Area. A street or alley may not be used for maneuvering directly into or from any parking space located wholly or partially outside the public right-of-way, except for Residential Care Services with four (4) or fewer spaces provided, single-family residential development, mobile home dwellings, or duplexes on individual lots. These exceptions are not applicable on MS&R designated streets as provided in Sec. 3.2.14.3.
Also:
3.4.4.2 Access Requirements. Access to a loading space shall be from a street. Access from an alley is also permitted, provided the alley is at least twenty (20) feet wide, paved for its entire block length, and zoning on both sides of the alley, for its entire length within the block, is nonresidential.
A. A street may be used for maneuvering of a delivery vehicle into, or out of, a loading space, provided it is for a use with only one (1) space, and if:
1. The street is not shown on the Major Streets and Routes (MS&R) Plan; or
2. The street is not a local residential street; or
3. The street does not abut a residential zone within the same block or within three hundred (300) feet of the nearest point of access to the loading zone. The three hundred (300) foot distance does not apply to the opposite side of a major street.

4. L.U.C. 3.3.7.3 Surfacing Requirements. All vehicular use areas shall be surfaced with one (1) of the following materials.
A. Asphaltic concrete.
B. Cement concrete.
C. A penetration treatment of bituminous material and seal coat of bituminous binder and mineral aggregate.
D. Exception. Vehicular use areas for Residential Care Services with four (4) or fewer spaces provided, single-family residential development, mobile home dwellings, and duplexes on individual lots are not required to comply with surfacing requirements.
5. All easements must be recorded prior to the approval of the Grading plan. Per previous comment
6. Add the following notes to the grading plan notes:
" "The approved Grading Plan is the only acceptable construction plan onsite. The Contractor may not use any other plans, such as the approved Tentative Plat and/or Development Plan, for construction purposes. The Contractor may ask the Development Services Inspector to consult with the other approved plans for additional information or details that might not be included on the approved grading plan but needed for completion of work."

" "The contractor shall remove the fine materials from the bottom of the detention/retention basin and scarify the basin bottom once the construction activities are completed in order to remove any fine material build up caused by construction and to restore soil percolation."

" "Any engineering work to be done below grade (i.e. toe-downs, cutoff walls, drainage pipes/structures, etc.) shall not be back filled until Development Services Inspector inspects the work and approves it."

7. List administrative address/site address on plans.
8. List Site plan number (T07CM03569) on the plans.
9. A permit or a private improvement agreement will be necessary for any work performed within the Right-of-way. Contact Permits and Codes at (520) 791-5100 for permit information.
10. Delineate 100-year W.S.E.L., Floodplain and erosion hazard setback.
11. Call out all slopes and stabilization material (concrete, riprap, gabbions or vegetation).
12. Slopes of 3H: 1V require hand placed riprap.
13. Slopes of 2H: 1V or greater require grouted riprap.
14. Cut or fill slopes require a 2' minimum setback from property line.
15. Placement of fill in excess of 2' above existing grade at any location in the outer 100' of the developing site is not allowed and/or shall meet the requirements per D.S. 11-01.
16. Drainage patterns with percent slopes (Show patterns within the first 100 feet from the property line).
17. Flow arrows, grades and flow rates within and adjacent to site to show drainage scheme.
18. Call out peak discharges entering and exiting the site.
19. Detention/Retention:
" Match Drainage report.
" Cross-sections and dimension.
" Dimension basin and provide spot elevations.
" Security barriers are required if ponding depth exceeds 2 feet, if slopes are greater than 4:1 and/or if pedestrian access is adjacent to basin.
" Water surface elevations.
" Peak discharge at basin's outlet.

Drainage report:
1. Please include a response letter to the comments along with the corrected copies of the DR.
2. If any excerpts, figures, data etc. have been taken from the Canterbury Ranch DR, then a statement must be added to the DR indicating that you have read and agree to that excerpt. My apologies for not being clear on the first set of comments. The excerpts, figures data etc. from the Canterbury Ranch DR shall be included in the report in order to facilitate the review. It is difficult figure out where the off site stormwater is coming from without the exhibits from the DR.
3. Discuss if any adverse impacts that may occur to the road or retention basin with the road passing through it: Such as percolation rates and impact of the road in the retention basin.

Stormwater pollution prevention plan:
Site Map

1. Show, on the site map, the concrete wash-out area.
2. Show, on the site map, both sides of the channels receiving stormwater shall incorporate stormwater protection.
3. Show, on the site map, locations where stabilization practices are expected to occur. (Part IV.C.3.d)

Stormwater Controls

4. Describe all pollution control measures (i.e., BMPs) that will be implemented as part of the construction project to control pollutants in stormwater discharges. (Part IV.D.1)
For each major activity identified in the project description, the SWPPP must clearly describe appropriate control measures; the general sequence during the construction process that the measures will be implemented; and which operator is responsible for the control measure's implementation. (Part IV.D.1)
NOTE: Offsite material storage areas (also including overburden and stockpiles of dirt, borrow areas, etc.) used solely by the permitted project are considered a part of the project and must be addressed in the SWPPP.

Erosion and Sediment Controls

5. Specify that when sediment escapes the construction site, offsite accumulations of sediment must be routinely removed and at a frequency sufficient to ensure no adverse effects on water quality.
Stabilization Practices

Structural Practices

6. Describe structural practices to divert flows from exposed soils, store flows or otherwise limit runoff and the discharge of pollutants from exposed areas of the site to the degree attainable. Placement of structural practices in floodplains shall be avoided to the degree attainable. A combination of sediment and erosion control measures is required to achieve maximum pollutant removal.
7. Provide adequate sediment basins. (Part IV.D.5.a.).
a. For drainage locations serving less than 10 acres, smaller sediment basins and/or sediment traps shall be used. Silt fences, vegetative buffer strips, or equivalent sediment controls are required for all down slope boundaries (and for those side slope boundaries deemed appropriate as dictated by individual site conditions) of the construction area unless a sediment basin providing storage for a calculated volume of runoff from a 2 year, 24 hour storm or 3,600 cubic feet of storage per acre drained is provided.
8. Place velocity dissipation devices at discharge locations and along the length of any outfall channel to provide a non-erosive flow velocity from the structure to a water course so that the natural physical and biological characteristics and functions are maintained and protected (e.g. no significant changes in the hydrological regime of the receiving water). (Part IV.D.5.b).
Note: The velocity dissipation devices must be in place during the construction phases. Installation scheduling must be included and should be as early as practicable.
9. Describe post-construction storm water management measures that will be installed during the construction process to control pollutants in stormwater discharges after construction operations have been completed. Structural measures shall be placed on upland soils to the degree attainable. Such measures must be designed and installed consistent with applicable local or state stormwater management requirements. (Part IV.D.6).
Non-Stormwater Discharges
10. Describe measures to prevent the discharge of solid materials, including building materials and litter, to waters of the United States. (Part IV.D.8.a).
11. Describe measures to minimize off-site vehicle tracking of sediments. (Part IV.D.8.b).
12. Describe measures to minimize the generation of dust. (Part IV.D.8.b).
Permit Related Records
13. Include a copy of the general permit and the NOI that was or will be submitted to ADEQ. If other agreements with any state, local, or federal agencies exist that would affect the provisions or implementation of the SWPPP, include copies of those agreements. (Part IV.F).
Signature Requirements
14. All NOIs must be signed and certified as follows:
a) For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer means:
i) A president, secretary, treasurer, or vice-president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision-making functions for the corporation; or
ii) The manager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of the regulated facility including having the explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
b) For a partnership or sole proprietorship: By a general partner or the proprietor, respectively; or
c) For a municipality, state, federal, or other public agency: By either a principal executive officer or ranking elected official. For purposes of this section, a principal executive officer of a Federal agency is the chief executive officer having responsibility for the overall operations of a principal geographic unit of the agency (e.g. Regional Administrators of EPA).
15. Reports and Other Information: All NOTs, SWPPPs, reports, certifications, or information required by this general permit and other information requested by the ADEQ or authorized representative of the ADEQ shall be signed by a person described in Part VI.K.1 or by a duly authorized representative of that person. A person is a duly authorized representative only if:
d) The authorization is made in writing by a person described in Part VII.K.1;
e) The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity, such as the position of manager, operator, superintendent, or position of equivalent responsibility or an individual or position having overall responsibility for environmental matters for the operator. (A "duly authorized representative" may be either a named individual or any individual occupying a named position.); and
f) The signed and dated written authorization is included in the SWPPP and submitted to the ADEQ upon request.
16. Certification. Any person signing a documents under the terms of this permit shall make the following certification: I certify under penalty of law, that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations.
