SUMMARY: The revised grading plan package and Floodplain Use Permit application were reviewed by Engineering and a meeting was held 12DEC07 to go over grading and Final Plat comments. Engineering recommends conditional approval of the Grading Plan. The remaining comments shall be addressed in the resubmittal. The Drainage Report was reviewed for Grading Plan purposes only.

GRADING PLAN CONDITIONAL APPROVAL COMMENTS:
1) City of Tucson Development Standards (DS) Section 11-01.8.1.A.1-4: Regarding status of differential grading, provide copy of the letter also faxed to Council Office, if not already sent for Final Plat review.
2) For sheet 7, keynote 14, label existing sewer as being "removed". Add note regarding private existing 8"VCP sewer line that exists and shall be relocated in phase 1 of the grading for this project.
3) Address SWPPP comments including:
a) Add PHX contact information to cover sheet of SWPPP or SWPPP report, in case of a spill.
b) Update silt fence detail.
c) The Stormwater Pollution Prevention Plan (SWPPP) shall be stamped approved once grading plan is approved.

Floodplain Use Permit conditions and grading permit conditions will be generated at next resubmittal. After addressing the above comments as discussed from meeting, resubmit three copies of the revised grading plan, three copies of the SWPPP, floodplain use permit application, one copy of the final drainage report, copy of the differential grading documentation, latest title report, any permission letters, response letter, and remainder of package. GRADING PERMIT CONDITIONS:
The following 18 conditions apply to this grading permit T05BU01915:
1) Call for Pre-construction meeting. For a DSD Engineering Inspection, call IVR (740-6970), or schedule with a Customer Service Representative at the Development Services Department, or contact DSD Engineering at 837-4888, or schedule inspections online at: http://www.ci.tucson.az.us/dsd/Online_Services/Online_Permits/online_permits.html
2) A copy of the approved Grading Plan and Permit shall be kept at the site at all times, until final grading approval.
3) These sets of plans act as the approved final grading plans for private grading, paving and drainage construction for CANTERA Subdivision Grading Plans, 4050 E Benson Hy. This grading permit T05BU01915 provides permission to perform private grading, stockpile removal, paving and drainage improvement construction as shown on the approved plans. See Floodplain Use Permit T07OT02747 for Floodplain Use Permit conditions.
4) See the approved Grading Plans for Private CANTERA Private Grading Plans (sealed by Jefferson D. Stine, 12-20-07). The grading permit T05BU01915 will be for earthwork and grading construction for subdivision improvements within the approved grading limits as shown on the approved grading plan.
5) There shall be no disturbance outside of the disturbance/grading limits. Any activity outside of the project boundary may require a construction or maintenance easement and may be required to be reviewed if not already shown on the approved plans.
6) Contact Permits and Codes (837-6606) for any questions regarding City of Tucson right-of-way permit requirements.
7) If grading construction is expected to last longer than the expiration date of the grading permit, contact DSD to renew/extend the Grading Permit. If Final Grading Inspection has not been completed before the Grading Permit expires, and the permit has not been renewed, additional fees and reviews may be required.
8) Revisions to the design must be discussed with a Civil Engineer at the City of Tucson Development Services Department Engineering Division, prior to any construction activity, to determine whether additional details, calculations, drainage report, or a revised grading plan is needed, or, whether changes may be provided on as-builts. All work completed without approval is subject to Stop Work Order.
9) The permitee shall notify the DSD when the grading operation is ready for final grading inspection. Final grading approval or release of reseed bond shall not be given until all work, including installation of all drainage improvements and their permanent protective devices, and all permanent erosion control measures have been completed in accordance with the approved grading plan and grading permit, and all conditions of permit are completed. Any revegetated areas shall require Landscaping approval of established vegetation prior to reseed bond release. Any other exposed areas that are not reseeded shall be covered in gravel, unless other material is proposed and reviewed by the City of Tucson.
10) City of Tucson, DSD Grading and Engineering Inspector shall complete a sidewalk and curb and gutter inspection before final grading approval.
11) Special inspections are required for any cut-off walls, and toedowns.
12) Project Engineering and Geotechnical Engineering completion letters, as well as As-Builts are required to be submitted prior to final Grading Inspection. Letters of certification from Engineer of Record for basin function and project substantial completion are required and shall be submitted prior to final grading inspection.
13) For inspection purposes, post the AZPDES - Posting Requirements green sheet at construction entrances to the site at beginning of construction activities and maintain these posted documents throughout project construction.
14) See the associated Stormwater Pollution Prevention Plan dated 1-2-08 (& 3-4-08: sheet 2) as a part of this grading permit. Interim erosion and sediment controls shall be maintained through out the life of the project per approved grading plans and SWPPP at disturbance limits.
15) Designated concrete washout locations shall not be located in the water harvest or basin area.
16) Temporary erosion and sediment control devices shall be placed at locations where stormwater runoff exits grading limits to prevent debris, construction silt, and/or chemicals from entering any drainage ways that eventually discharge into the receiving waters. Interim erosion and sediment controls shall be maintained per approved grading plans at downstream areas of disturbance limits.
17) The operator shall report to ADEQ any noncompliance (including spills) which may endanger human health or the environment. The operator shall orally notify the office listed below within 24 hours: Arizona Department of Environmental Quality, 1110 W. Washington, 5th floor (5515B-1), Phoenix, AZ 85007, Office: 602-771-4466; Fax 602-771-4505
18) Stockpile permit T06BU00133 shall be resolved by earthwork for approved improvements to the site. Any permanent erosion and sediment controls including gravel and/or reseeding shall be placed and established prior to release of any bond and prior to any request for final approval.

APPLICANT'S NAME: STARDUST CANTERA

The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

Subdivision platted as Cantera (Bk 63 pg 44), 4050 E Benson Hy, Tucson, AZ 85706, in a portion of Township 15 South, Range 14 East, Section 10, Ward 5,

for the purpose of subdivision-associated infrastructure including street and drainage improvements for Cantera residential subdivision.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 11 conditions apply to this permit T07OT02747:
1) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T07OT02747. FOR INFORMATION PLEASE CALL 791-5550."
2) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times.
3) All work shall conform to the accepted Drainage Report for Cantera (Prepared by Castro Engineering sealed 7-15-05 and addenda (prepared by eps Group sealed 11-20-07), the approved PRIVATE GRADING PLANS, activity number T05BU01915, by eps Group (dated 12-20-07), and associated geotechnical reports with any addenda, which is made part of this permit.
4) A temporary stockpile permit T06BU00133 was issued for this site and the final grading under grading permit T05BU01915 shall provide permanent improvements for the project. Any permanent erosion and sediment controls including gravel and/or reseeding shall be placed and established prior to release of any bond and prior to any request for final approval to assure no impact to the adjacent floodplain located to the north of the stockpile.
5) This permit does not authorize the construction of the building pad or building of structures. Any construction shall be authorized by a separate building permit. Any walls to be constructed will require a separate building permit. See grading permit T05BU01915 for grading information.
6) Floodplain Engineering inspections required. Call for Pre-construction meeting, SWPP inspections, channel toedown inspections, and final inspections. 7) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
8) There shall be NO disturbance or stockpiling in the floodplain areas of the project as depicted on the plans, or outside of the grading limits, whichever is more restrictive.
9) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the structure and / or site development, or, if there is any further disturbance within the floodplain other than that outlined in the approved grading plans. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson.
10) Any additional future disturbance of the floodplain shall have separate Floodplain Use Permit applications submitted to this office for review and approval.
11) As-built plans required to be submitted prior to final DSD Engineering inspection, including as-built elevations for lots and common area along constructed channel, inverts for stormdrain pipes, as well as other drainage improvement areas.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire two years from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
