07/24/2007 ANDREW CONNOR LANDSCAPE REVIEW Denied A water-conserving irrigation system is required for all new landscape planting. An irrigation plan shall be submitted together with the landscape plan per LUC 3.7.7.2. Submit irrigation plan with mitigation plan.
07/24/2007 ANDREW CONNOR NPPO REVIEW Denied 1) Revise the plans to include the railroad right-of-way. We find that this proposal to remove native vegetation in order to install the pipeline is not relevant to the rights and responsibilities along the right-of-way and we also do not concur that the railroad has the right to maintain the entire right-of-way clear of vegetation. Revise note 3 on sheet 1.

2) Revise the plans to provide for additional waterings in order to aid plant establishment when necessary. A provision should be included to irrigate plants as needed based on monitoring. Any plant material in areas of required landscaping that does not survive will be replaced with an equivalent size and species within thirty (30) days.

3) Water harvesting is a required component of the irrigation standards. Provide notes or details. DS 2-07.2.2.C

4) The Plan shall affirm, by a statement on the Plan, conformance with the requirements of the Federal Endangered Species Act and the Arizona Native Plant Law. Applicants are advised of required salvage permits which must be obtained from the U.S. Fish and Wildlife Service for the applicable Endangered and Threatened genus and species and required notification which must be provided to the Arizona Department of Agriculture prior to site modification. Compliance with this Division does not constitute conformance with state or federal regulations.

5) Identify (by docket and page) and locate on native plant preservation plans all utility easements and facilities and other types of easements, such as construction access and slope easements. Easements should allow for continued maintenance access for the plant establishment period where applicable. DS 2-07.2.2.E

6) General Notes for Seeding Programs

The applicant is expected to do whatever is necessary to prepare the site to guarantee plant establishment to the satisfaction of the City. The applicant will not be required by the City to irrigate but will, however, be responsible for successful establishment of vegetation using the appropriate seeding/irrigation method. A stand of vegetation shall be considered established when: A minimum of one (1) perennial seeded species per square foot has rooted, developed true leaves, and is in a state of continual positive growth, and the interspace area between perennial species has a minimum of one (1) annual or perennial plant in any stage of development or growth other than seed. Sites are to be maintained during the establishment period to remove weeds and inhibit the incursion of non-native species. DS 9-06.4.2

7) Revise the plans to include addresses/parcel codes and/or brief legal descriptions for each parcel affected by the pipeline installation. DS 2-07.2.1.B

8) Prior to any site disturbance a Native Plant Preservation inspection is required by the City of Tucson to check preservation fencing and plant identification. Call (520)837-4950 to schedule prior to vegetation removal.

9) Revise the plans to identify the limits of clearing.

10) Portions of the pipeline appear to cross regulatory floodplain areas. These areas in may cases contain riparian habitat. This habitat may not unnecessarily altered per TCC Sec. 26-5.2. Refer to DS 2-13 for the preparation, submittal, and review procedures for development within areas that have environmentally valuable habitat in conformance with Article 1, Division 1, Floodplain and Erosion Hazard Area Regulations.

Submit an Environmental Resource Report (ERR) per DS 2-13.2.5.B.1 if encroachment is proposed in the regulatory area. The report will document (1) the areas that contain riparian and wildlife habitat that is to be preserved and (2) those areas without such habitat within the regulatory floodplain.

All tentative plats, development plans, site plans, plot plans or other plans providing for approval of development within property that includes any Regulated Area as defined in Development Standard 2-13.2.2.A shall identify and delineate the Regulated Areas and the Protected Riparian Area Revise the plans as necessary.

Where any development encroaches within the Protected Riparian Areas, mitigation will be required. A mitigation report shall be submitted with the Environmental Resource Report demonstrating that the proposed mitigation is in conformance with this subsection and applicable codes. DS 2-13.2.5.C

Landscape plans are required to document compliance with the mitigation plan requirements. A summary of floodplain & mitigation and preservation requirements shall be included on the plans. The plans shall show the location of mitigation areas; techniques used for mitigating impacts to, or preservation of, natural areas; specifications for restoration and revegetation of disturbed areas; and general compliance with the applicable standards. Revise as necessary.

Encroachments that cross the Protected Riparian Area shall be located and constructed to minimize disturbance of the habitat and wildlife movement and utilities will be placed either in proposed or existing public right of way along roadway, bike path, or paved walkway improvements or within approved easements. DS 2-13.2.5.B.2

Ownership of the Protected Riparian Area shall be provided in one or more of the methods set forth in DS 2-13.2.6 to insure continued preservation of the area. Refer to the standards and revise the plans and provide additional documentation as appropriate.

08/21/2007 ELIZABETH EBERBACH ENGINEERING REVIEW Denied TO: CH2MHill / Blue Mesa Studios
SUBJECT: Kinder Morgan pipeline maintenance Site Plan Review
REVIEWER: Elizabeth Eberbach
ACTIVITY NUMBERS: T07CM02836, T07OT01888

SUMMARY: Engineering Division of Development Services Department reviewed the floodplain use permit application, and the combo permit application submittal, that included the NPPO plans for the Kinder Morgan Pipeline project, SWPP report, and ERR-drainage report. Engineering does not recommend approval at this time. The ERR-drainage report was submitted 21AUG07 with the Floodplain Use Permit. Portions of the SWPP report (sealed copy, General Permit, and NOI) were submitted 21AUG07.

SITE PLAN AND FLOODPLAIN COMMENTS:
1) Tucson Code Sec. 26-11.2.(f): For the Environmental Resource Report / drainage report, address the following floodplain comments:
a) Tucson Code Chapter 26 Article I Division 1 Section 26-5.2(4): There are riparian floodplain areas on the portions of project which are subject to City of Tucson standards and code restrictions. Per floodplain and erosion hazard area regulations, 100-year floodplain riparian areas shall not be unnecessarily altered. Clear delineation of the overlapping area of the 100-year floodplain limits and the limits of riparian area on drainage exhibit(s). Necessary alteration includes necessary all weather access to a site where there are no other access, or necessary utility crossing disturbance where there are no other locations for the utilities, or other necessary development where there are no other alternatives. Utility maintenance is considered a necessary alteration of the riparian floodplain. The riparian area and any encroachment must be accepted by Landscaping as well as Engineering with the review and acceptance of the ERR drainage report which is required with the riparian floodplain review. The project shall reflect ERR conformance in the plan and drainage report. Address the following comments:
i) DS Sec.2-13.2.5.B.1: The proposed pipeline crosses FEMA and local jurisdictional floodplains. The ERR drainage report shall have exhibits that show delineated floodplain limits on plan views. There shall be an exhibit that shows both the floodplain limits and the protected riparian limits;
ii) Label FEMA zones on plan view;
iii) DS Sec.2-13.2.5.B.1.p: On ERR drainage report exhibit, label areas of overlapping floodplain/riparian areas as Protected Riparian Area.
b) Regarding the ERR Drainage Report, address the following:
i) Provide discussion to clarify how construction and placement of pipe at the crossing at DL2 will be protected from any adverse conditions, including complete discussion of compaction of trench and cover backfill;
ii) Provide discussion of how the treatment of the existing pipeline (if it is to remain) will not adversely impact the jurisdictional floodplain or groundwater in the areas of DL2 and DL3;
iii) Provide a summary of the schedule of construction activities to include utility identification to revegetation/mitigation, with a general expected time line.
c) If not shown on the plans, provide information regarding the depth, material, and size of existing pipe at floodplain crossings DL2 and DL3.
d) Condition of permit shall include required submittal of all copies of compaction reports, with special inspection reports at the floodplain locations, to be submitted to Engineering Division Development Services Department City of Tucson. These reports shall be sealed by a geotechnical registrant of the State of Arizona.
2) Provide copies of the pipeline installation construction plan sheets that provides the following information:
a) depth of proposed pipe at floodplain crossings DL2 and DL3;
b) material and size of new pipe.
3) Submit a copy of the 100-ft temporary construction easement that provides access across parcels that are proposed for construction. Add information to plan for all parcel codes and addresses for each parcel affected by the pipeline installation. If acceptable docket and page is not provided for full scope of project, separate permits must be obtained for each parcel.
4) For the SWPP report, a sealed copy is needed with the AzPDES General Permit and copy of NOI that was submitted to ADEQ. (Submitted 22AUG07)
5) For resubmittal, provide 3 copies of the site plans, 3 copies of the revised ERR drainage report, 3 copies of the revised updated SWPP, 1 copy of the docket/page of easement, 2 copies of the construction plan sheets, and a response letter.
