TRANSMITTAL DATE: August 13, 2007

COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. This project was reviewed for compliance with the Land Use Code (LUC) and Development Standards (DS). This project consists of a proposed entry feature to be constructed over the vehicle use area at the entry to the existing condominium development.

2. The last approved site plan document for the overall site was not found in the submittal package, as was listed on the submittal application as being accompanying in the submittal package. This site plan is required for further reviews of this project. Note, a smaller reference drawing of the area of proposed installation was found in the submittal package, and was used for reference in this review. The accompanying elevation drawings were also utilized for this project review.

3. The site is zoned R-3, a high density residential zoning classification. Per LUC 3.2.5.3.B, Accessory structures (within residential zones) shall not exceed 12' feet in height.

While the exact height of the structure (from grade to the highest point of the archway) is not given, the submittal indicates a height at the midpoint of the archway rafter - at the peak of the arch - is greater than 17'. Exceeding the height allowance described in LUC 3.2.5.3.B would require a Board of Adjustment variance to this section of the LUC.

4. To construct this feature over a PAAL requires that the lowest point of the archway be at minimum, 15' tall per DS 3-05.2.1.4.A. Please demonstrate that the arch area where traffic is proposed, would meet this height.

5. Per DS 3-05.2.2.B.3, a minimum of a 2' setback must be maintained between any vertical object over 6" and a PAAL. Demonstrate that the archway pillar will have a 2' setback from the vehicle use area -(i.e. curbing?)

6. Per LUC 2.3.6, the minimum setback required for the structure to the property line at the north is the greater of 10' or ¾ of the height of the structure. The proposal package indicates a letter of approval for a reduced setback was obtained from the neighboring property to the north, however, that letter was not found in the package. Please provide a copy.

7. Please provide the zoning of the adjacent parcel to the west - within Pima County limits - to determine the required setback. (It appears that the Pima County zoning to the west is SR, which requires a 25' setback, which if verified, means that the building setback to the west is insufficient.)
