This site plan was reviewed for compliance with the City of Tucson Development Standards (D.S.) and Land Use Code (LUC) and for compliance with the review guidelines for smoking patios, dated April 02, 2007. Based on this patio being used for "SMOKING ONLY" this use is an accessory use only therefore it is not counted as an expansion. Any changes to this use may require additional review and comments. 2. Label the patio as "SMOKING PATIO ONLY, NO FOOD OR BEVERAGE SERVICE PERMITTED". 3. The maximum square footage for a smoking patio is 200 sq. ft. If the proposed covered patio is to remain as shown on this plan This site plan will need to be reviewed for full code compliance with the City of Tucson Development Standards (D.S.) and Land Use Code (LUC). This is due to a greater than 25% building area expansion. Per the LUC if a series of expansions cumulatively results in a twenty-five (25) percent or greater expansion in floor area full code compliance is required for the full site. Based on the last approved site plan with an existing building square footage of 5,762 and the expansions shown on the plan of 164 and 705 plus the proposed expansion of 1192 on this plan equals a total cumulative expansion of 36%. 4. Provide a note on the plan "WALLS OR FENCES ARE PERMITTED WITH A MAXIMUM HEIGHT OF 3.5 FEET. 5. Provide a note on the plan "NO GATES ARE PERMITTED. A MININUM 4 FOOT WIDE PEDESTRIAN OPENING TO PUBLIC COMMON AREAS IS REQUIRED TO CONNECT TO THE PEDESTRIAN CIRCULATION PATH OR TO A PAVED PARKING LOT". 6. Provide a note on the plan "NO TABLES ARE PERMITTED IN THE PATIO". 7. Per TC, Sec. 11-19.A.3.b the pedestrian circulation, sidewalk, which connects the vehicular use area located on the south side of the existing structure to the pedestrian circulation, sidewalk, located on the north of the existing structure may not pass through the "SMOKING PATIO". 8. Per D.S. 2-08.3.1 a pedestrian circulation path must connect all areas of public access on site. This pedestrian circulation must be on site. 9. It appears that a zoning violation has occurred on site. Per current aerial photos parcel 128-01-017H that is part of this site (west parcel) has been graded without a permit. This has been turned into the Department of Neighborhood Resources, T06DV03035. 10. Additional comments may be forth coming depending on how each comment has been addressed. This project is a cumulative expansion of over 25%, therefore a full code compliance review is required. The submitted site plan must meet the requirements of Development Standards 2-02. 2. Provide bearings for all lot dimensions. DS 2-02.2.1.A.5. 3. There is a median located within Wilmot Road. The standard requires a pedestrian sight visibility triangle (SVT). Be advised the near side SVT the standard calls for a length of 30' rather then125'. Revise appropriately. DS 3-01.5., DS 2-02.2.1.A.10. 4.
