COMMENTS: Please resubmit revised drawings and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. This site plan was reviewed for compliance with the City of Tucson Development Standards (D.S.) and Land Use Code (LUC) for full code compliance.

2. This comment was not addressed. Zoning acknowledges your response but was unable to find the cross parking, cross access easement. The provided CC&Rs appear only to address cross access. Per the architectural site plan the only common area that is shown is parking area access lanes (PAAL's). Clarify how this document addressed the requirement for cross parking. Cross access & parking agreements are required and must be recorded at the Pima County Recorders office prior to site plan approval.

3. Based on the information provided in Permits Plus the lot split has not been completed at this time. It appears that the recorded legals have not been submitted to DSD. Zoning acknowledges that a lot split has been started (S07-059) but at this time has not been completed. Zoning cannot approve this site plan until the lot split is finalized. Provide documentation, which supports the lot split/lot line realignment, which was done on the property in late 2006. There also appears to be two (2) different property lines to the south of the proposed building, clarify.

4. Based on your response to comment 6, if the sidewalk along the north side of the building is flush with the pavement then truncated domes are required at the crosswalk located near the northwest corner of the building. Also truncated domes are required at both handicapped access aisles. Detail 5/C4 calls for ramps down to a landing that is flush with the pavement and your response states that "The sidewalk on the north side of the building is flush with the adjoining pavement", please clarify. It is still not clear how the accessible route functions at the northeast corner of the existing building on lot 1. Is the sidewalk flush with pavement or is an access ramp proposed. Per your response, zoning was not able to find any reference to "not for public use and is labeled as such on the plan. It is unclear how the accessible route functions. How does a handicapped person access the sidewalks at both ends of the crosswalk? D.S. 2-02.A.2.1.12 Per D.S. 2-08.3.0 a pedestrian circulation/accessible route is required to connect all public access areas of the development to the pedestrian circulation path located in adjacent street.

5. Zoning did not ask for the existing use of Lot 1. Per D.S. 2-022.1.A.31 provide the existing use for Lot 2. Per the Development Data, sheet T-1, provided with the building plan submittal no existing use is shown. D.S. 2-02.2.1.A.31 Show the existing use on the plan.

6. Zoning acknowledges LUC Sec. 2.8.3.5 and that an adjustment is allowed when property is set aside for future MS&R improvements. Per the submitted site plan the existing half right-of-way is shown as forty (40) feet. Per the City of Tucson MS&R map the future right-of-way for Bilby is sixty-four (64) feet or a half right-of-way thirty-two (32) feet. If the future right-of-way is less then the existing where is the set aside property for future MS&R improvements.

7. Zoning acknowledges compliance with LUC Sec. 2.8.5.5.B.2. LUC Sec. 2.8.5.5.B.3 limits the height of the building to seventy-five (75) feet. Per LUC Sec. 2.8.5.11 this height is based on distances away from established ends of runways and designated Median Sea Level (M.S.L.) elevation. Review LUC Sec 2.8.5.11.B and provided a height for the proposed building in regards to the M.S.L. for the northeast end of runway 21. Zoning acknowledges the information shown under the legend in regards to the Airport Hazard District. This information in not correct. The maximum height above the M.S.L. is seventy-five (75) feet. Demonstrate how this project complies with the requirements of LUC Sections 2.8.5.5.B & 2.8.5.11.

8. Zoning is willing to provide an over the counter review once all the above comments have been addressed. Please call or email for an appointment.

9. Ensure that all changes to the site plan are reflected on the landscape & grading plan.

SUMMARY: Engineering Division of Development Services Department has received and reviewed the revised site plan (T07CM00265), grading plan (T07BU00156), Drainage Report (CMG Drainage Engineering, LLC, dated 24APR07 and addendum 23AUG07), Phase I Drainage Report (CMG Drainage Engineering, LLC, dated 12MAY04), Geotechnical Addendum (Western Technology, Inc., dated 16APR07), Declaration and Establishment of Protective Covenants, Conditions, and Restriction (Docket 13029, Page 5355), Agreement Package, and Stormwater Pollution Prevention Plan (SWPPP). The site plan and grading plan are not approved at this time. Please address the following comments:


SITE PLAN COMMENTS:

1) DS Sec.10-02.2.3.1.5: The proposed Agreement Package from the adjacent property owner for the use of the proposed offsite detention basin B and all drainage improvements located on Lot 1 addresses the use and maintenance of the offsite improvements. However this document must be signed, notarized and recorded prior to site plan approval. Provide the recorded document at resubmittal for site plan approval. Provide a note on the site plan that addresses this Agreement and the maintenance of all drainage improvements.

2) DS Sec.2-02.2.1.A.32: The revised Detail 2 on Sheet C4 does not show the minimum inside clear dimension of 10 feet by 20 feet between the steel bollards that are required between the container and the enclosure's rear and sidewall (refer to redlines on sheet C4 for clarification). The 10-foot dimension from the enclosure gate must be to the front of the back bollards not the CMU wall, revise.

3) Review and approval from TDOT Permits and Codes for all improvements within the public right-of-way will be required. A right-of-way use permit application will be required prior to construction. Refer to the following links for TDOT Forms and applications:

GRADING PLAN: Be advised that the grading plan can not be approved prior to site plan approval. All comments associated with the site plan must be submitted for review and the site plan must be approved prior to grading plan approval.

4) DS Sec.10-02.10.9.1.8: Revise Detail 2 on Sheet C3 to call out the Standard Public Improvement Detail for the proposed typical riser type clean out with the cast iron cover. Show all details and dimensions for this transition from the 18-inch to 24-inch storm drain. Provide the concrete thickness around the pipes; dimension the width and depth of the chamber along with the distance between top of storm drain and the bottom of the cast iron cover.


STORMWATER POLLUTION PREVENTION PLAN COMMENTS: The SWPPP and exhibits prepared by CMG Drainage Engineering Inc, dated 24AUG07 have addressed all comments from my previous comment letter. The 3 copies of the SWPPP and exhibits must be returned with the site plan and grading plan submittal for stamped approval.


GENERAL COMMENTS:

Please provide a revised site plan, a revised grading plan, and the 3 SWPPP copies that address the comments provided above. For expedite purposes the site plan and grading plan can be reviewed over the counter for stamp approval once all items have been addressed.
