COMMENTS:
1. This project was reviewed for compliance with the Land Use Code (LUC). The criteria specified in this project review as needing variance referral involves sections: LUC 2.3.4., which refers to the R-2 zone, LUC 3.2.5, referring to accessory structures, LUC 3.2.6.4 Perimeter Yard Indicator "AA" and LUC 3.2.6.5.A., referring to minimum required building setbacks.

This project is to construct a carport in the front yard of the existing R-2 zoned residence. This carport is to be detached.

2. Per LUC 3.2.6.4 Perimeter Yard Indicator "AA", the required minimum building setback for a structure adjacent to an R2 zoned parcel is 6' or 2/3 the height of the proposed exterior building wall, which ever is greatest, as measured from the building wall/post to the west property line. The applicant proposes to construct a detached carport a total of 0 feet from the west property line, requiring a variance.

3. Per LUC 3.2.6.5.A, the required minimum building setback for a structure on an established street is the greater of 20' or 1.5 times the height of the exterior building wall, as measured from the building wall/post to the street front property line of W. 2nd Street. The applicant proposes to construct a detached carport a total of 2.5 feet from the street front property line, requiring a variance.

4. Per LUC 3.2.5.3.C, a detached accessory structure is not permitted to be constructed in the area between the front building wall and the street front property line (front yard). The applicant proposes to construct a carport detached from the residence, positioned 13' in front of the residence, requiring a variance.
