The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as (legal description):

LA ESTANCIA DE TUCSON BLOCKS 1, 2, 3, 4, 5, 11, 18, 19, 21

This permit is for the purpose of grading the La Estancia Subdivision, a portion of which contains a FEMA-delineated floodplain where the 100-year event is contained within the old Julian Wash channel, as shown on the Flood Insurance Rate Map (FIRM), Community Panel No. 040076-04019C-2855K, effective date February 8, 1999, revised by Letter of Map Revision dated June 16, 2000.

The applicant agrees to comply with the City of Tucson's Floodplain, Stormwater and Erosion Hazard Management Ordinance and the Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson's Floodplain, Stormwater and Erosion Hazard Management Ordinance and the Watercourse Amenities, Safety and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit. (Or refer to Chapter 26 page 35)

1. All work shall conform to the approved grading plans under Grading Permit No. T05BU01019, sealed by Sheila M. Bowen of Castro Engineering and which are made part of this permit.

2. The proposed fill shall be compacted to a minimum of 95% density to the elevations shown on the Grading Plan.

3. Until the Letter of Map Revision (LOMR) has been approved by FEMA for the change in the delineation of the Julian Wash, development on the following lots are subject to floodplain regulations and will require a floodplain use permit and an Elevation Certificate:

Lots 222, 223, 273-288, 299-302, 322-325, 523, 524, 532, 533, 539, 540, 547, 548, 565, 566, 599-602, 615-618, 633, 634, 646-652

4. This permit becomes invalid and is subject to additional floodplain review, if any required development permit(s) changes the configuration of the structure and or site development.

5. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.

6. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T06OT00412.
