TRANSMITTAL DATE: September 20, 2007

COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. This site plan was reviewed for full code compliance with the City of Tucson Development Standards (D.S.) and Land Use Code (LUC) due to an expansion of greater then 25% of building/structure area.

2. Zoning was unable to find the recordation information, docket and page, for the Covenant Regarding Development and Use of Real Property

3. D.S. 2-02.2.1.A.7 Based on a determination made by the Zoning Administrator when a parcel borders a street which is shown on The City of Tucson's Major Streets & Routes (MS&R) map all adjacent streets will use the requirements of LUC 3.2.6.5.B to determine the required setbacks. This said, based on the proposed building height of 50'-2" the required setback for Weymouth Street is 50'-2". Depending on the Average Daily Traffic (ADT) and the street cross section for Weymouth Street the required setback is either measured from the back of curb or nearest edge of travel lane. Once the ADT and street cross section for Weymouth Street are provided Zoning can verify if the proposed building meets setbacks.

4. Zoning is willing to provide an over the counter review once all the above comments have been addressed. Please call or email for an appointment.
