SUMMARY: The Overlay package including the W.A.S.H. Report, copy of the Tentative Plat, and Landscape documents were reviewed. The watercourse adjacent to this site, Rodeo Wash, is designated as a Watercourse Amenities Safety and Habitat (W.A.S.H.) Ordinance wash and review and approval is necessary for Tentative Plat approval. Subsequent to the meeting held January 11, 2006, to discuss the Tres Pueblos projects, Development Services Department Engineering Division has provided the following comments. At this time Engineering does not recommend approval of the overlay package until these comments are addressed.

W.A.S.H. OVERLAY COMMENTS:
1) Tucson Code Sec. 29-15(b)(1): Per this section of the W.A.S.H. Ordinance, address the following Wash Report comments for Rodeo Wash along the south portion of the project:
a) Tucson Code Sec.23A-50.(2): The plans continue to indicate proposed grading for drainage and trail structures in the W.A.S.H. Study Area. Typically, these improvements are discouraged within the resource areas of the study area. Per the new W.A.S.H. Ordinance of January of this year, if any portion of the 50-ft study area is proposed to be developed, the following needs to be addressed:
i) After addressing the comments for this submittal and the acceptance of the review package is provided by DSD, the W.A.S.H. submittal package will need to proceed to City of Tucson stormwater committee(s) for review including Stormwater Advisory Committee. This will occur if there are any placement of structures, paths of any type, or other grading disturbance proposed within the resource areas of the Study Area.
ii) Tucson Code Chapter 23A.Article II.Division 3.Sec.23A-50: Full notice procedure will also be required if there are any proposed disturbance within the study area.
iii) Tucson Code Sec. 29-15(b)(1): If any portion of the 50-ft study area is proposed to be developed, the W.A.S.H. Mitigation Plan included in the W.A.S. H. Report must be accepted.
b) Tucson Code Sec.29-15(b)(1): Assure that there are complete discussions regarding any effects on hydrology and hydraulics to the study area due to each of the elements a - i listed in this section of the Tucson Code. Address the following element comments:
i) Element a - In section 3.1, clarify how the flow rate increases between sections 16 and 17.
ii) Tucson Code Sec.23A-50.(1), Element b - Provide copy of soils report and discuss results in the W.A.S.H. Report. Submit a bound copy of the soils report that discusses suitability and feasibility of the project. Besides description of existing soil constraints for the site, and other typical geotechnical data, the soils report shall provide identification / assessment of any potentially hazardous geotechnical areas, provide proposed recommendations for minimum distance from foundations to drainage swales, and provide slope stability recommendations.
iii) Element c - In section 7.1 it was stated that the maintenance of box culverts and bank protection is the City's responsibility. Provide copy of dkt.7088 pg.754. State ownership of Rodeo Wash in section 6.1. Label the 80-ft drainage easement as public or private on exhibits.
iv) Element d - Explain whether there are any existing and proposed drainageway facilities on or adjacent to the site and identify the persons responsible for the maintenance of such facilities. Include discussion of how the cut-off structures within the wash will impact the proposed development.
v) Element f - In section 4.1 of the W.A.S.H. report, revise statement that there are no proposed improvements to the Rodeo Wash; it should be stated that there is a proposed trail and a proposed drainage outlet crossing the study area. Clarify the discussion of groundwater recharge potential by adding statement regarding the change in flows exiting the site / entering Rodeo Wash. Also state how the increased flow at section 16 impacts recharge potential.
vi) Element g - Regarding sediment transport characteristics, clarify how the impact of future erosion and lateral migration will affect the north bank of Rodeo Wash in section 4.2 of the W.A.S.H. report. Provide additional discussion in this section explaining how the development maintains the existing sediment transport conditions along this stretch of the Rodeo Wash to include impact from the disturbance of the proposed trail, existing cut-off structures, the increased flow at section 16, and the proposed drainage outlet crossing the study area and entering the wash. Explain whether/how the concentrated flows from developed conditions will impact sediment transport on the banks and within the wash.
vii) Element h - If there are any proposed utility crossing the wash, show extents of utility or easement disturbance areas within the W.A.S.H. study and resource areas on the W.A.S.H. exhibit with revised contour lines along the embankments. Explain how any proposed new utility crossings are laid out on the topography to prevent scour or erosion problems. Also state whether reasonable alternative locations for new utility lines improvements are available. Provide cross sections for existing and proposed grades and conditions at the utility crossings through the 50-ft study area and across the wash.
viii) Element i- Address the following regarding any other elements that may be characteristic of the watercourses on or adjacent to the site:
(1) On Tentative Plat sheet 3, there is a monument symbol located at top of wash bank at the southeast corner of the project. Label/identify monument on exhibits and tentative plat.
(2) Explain what improvements will be necessary for the Public Recreational Trail. Specifically discuss in report (and show on exhibit and Tentative Plat) any proposed grading activities, including placement of trail materials, compaction, or other type of earthwork or grading-related activity.
(3) There is a location where concentrated flows from onsite are proposed to discharge into the wash through the study area. Provide details for the drainage outlet facility at the southwest portion of the site within the W.A.S.H. 50-ft study area, including details and cross sections identifying type of proposed materials, slope grades, and dimensions. Hydraulic data is necessary within the drainage report as well.
ix) Provide introductory or closing statement in the W.A.S.H. report as to whether the development proposed, whether in the study area but not in the resource area, or within the resource area, is compatible with the purpose and intent of the W.A.S.H. Ordinance regulations. Add further clarification to last sentence in section 10.
x) From the meeting held 23JAN06, it was stated that the intent has changed and that no disturbance will be proposed. Please be aware that any required improvements (including mandatory trail, utility improvements, maintenance access improvements, erosion protection, or other drainage improvements or grading activities), will require justification and mitigation within the W.A.S.H. Report.
c) There are two exhibits titled Figure 4 and two Proposed Drainage Maps; clarify exhibits and table of contents; check exhibit titles.
d) One of the Figure 4 drainage exhibits shows a "50' Wash Study Area…" delineated along the south portion of the development near the wash. Show delineation on all figures 4 and 5 the 50-ft Study Area limits. Also provide clarification for any delineation for the resource area found within that study area on the exhibit 5.
e) For clarification within the reports, entitle the drainage exhibits as "W.A.S.H." exhibits.
2) LUC Sec.2.8.1.5.A: For further W.A.S.H. Ordinance overlay zone process and notification questions, see sections in the Tucson Code , or contact Zoning Manager Patricia Gehlen 791-5608 ext. 1179.

Submit a revised report for the W.A.S.H. Report with exhibits discussed in the above comments, revised Tentative Plat, response letter, and any other supporting documentation. 11/10/2005 JOE LINVILLE LANDSCAPE REVIEW Denied The Development Services Department has received the WASH application for Tres Pueblos IV. The application is accepted conditionally. However, a decision on the application cannot be made at this time. The following additions/revisions are necessary in order for Development Services to refer the application to the Stormwater Advisory Committee and to render a decision on the application. Please submit the items in conditions
1-7 below. Formal review and comment on the application will not proceed until the conditions are met.

1) A more detailed inventory; include basal trunk diameter, height measurement, and viability ratings for plants in the affected study area.
2) Representative photographs of the study area.
3) The mitigation plan will be required to provide 2:1 mitigation for shrubs removed.
4) A 3 year maintenance plan is required. The Maintenance Plan shall include a schedule or frequency of visits, types of scheduled and emergency maintenance activities, access requirements, identification of short-term and long-term responsibility, and a list of required maintenance easements and agreements.
5) Describe specifically why the Resource Area cannot be left in its natural state. (Why is the path located in the resource area, why does the drainage scheme require a channel that disturbs the resource area?)
6) Any additional information required by the Engineering Section.
7) 20 additional copies of the plant/habitat inventory and the preservation/revegetation plan, and 2 additional
copies of the Hydrology/hydraulic study plan will be required at a later date for distribution to the SAC and TDOT Stormwater. Typically, this submittal occurs when the applicant confirms that staff is scheduling the case for the Stormwater Advisory Committee agenda.
