05/16/2005 MATT FLICK ENGINEERING REVIEW Denied This letter responds to your request for Development Services Department comment that a proposed project would have with regard to the City of Tucson's floodplain and drainage regulations as it relates to Freeway Industrial Park, Lots 12-20. This request included an analysis of the existing conditions flooding and two (2) proposed alternatives to reduce flooding of Lots 12-20.

We reviewed the submitted data and determined that the proposed analyses are in conformance with the minimum floodplain management criteria established by the Floodplain Ordinance and Development Standards. We believe that if the proposed conditions analyses for the proposed drainage alternatives (titled Option 1 and Option 2 and shown on Figure 4: Offsite Drainage Plan) are constructed in general conformance to the proposed cross-sections and to all applicable standards and regulations, the developability of the sites will improve with respect to floodplain and drainage as regulated by the City of Tucson.

It should be noted that any future development alternatives as indicated in the report would be subject, at this time, to conformance with floodplain regulation per the Department of Homeland Security's Federal Emergency Management Agency Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) report for Pima County, Arizona and Incorporated Areas (the effective FIRM and FIS for this community) in accordance with Part 65 of the National Flood Insurance Program (NFIP) regulations. Acceptance by the City of Tucson of the concepts provided in the report titled "Offsite Drainage Report for Freeway Industrial Park Lots 12-20" does not result in a change to the effective hydraulic modeling or the effective FIS report and effective FIRM. A LOMR or Physical Map Revision issued by FEMA, in response to an application by the developer or other responsible party for Lots 12-20, may be necessary to change the minimum NFIP criteria used in regulating development on Lots 12-20. Development on Lots 12-20 must meet all Federal, State and local floodplain regulations and floodplain management criteria. The City of Tucson must regulate development in the SFHA in accordance with State and Federal regulations as well as it's own regulations.
