COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The number of required and provided handicapped spaces must be listed on the plans.

Previous Comment: Of the 30 parking spaces provided two of the spaces have to be handicapped and of the two handicapped parking spaces required one must be a van accessible space which requires an eight-foot wide accessible aisle. Revise the parking spaces as required and revise the parking calculations to reflect the handicapped parking requirements. DS 2-02.2.1.A.8

2. Copies of the finalized Assessor's Parcel Tax Code combo must be included with the next submittal. I received in the site plan package, a copy of the covenant with signatures and a notary stamp. If all comments can be addressed and the plans revised to comply with all requirements the covenant can be recorded. (Please ensure that the DSD site plan activity case number T05CM04911 is listed in section "B" of the covenant before recordation.) A copy of the recordation receipt for the recordation of the covenant needs to be submitted with the next site plan package or copies of the covenant with the recordation docket and page numbers stamped on the sheets.

Previous Comment: I acknowledge that an assessor's tax code combo is in progress. In addition to the Assessor's tax code combo a City of Tucson lot combo covenant must be recorded using the proposed site plan as an exhibit to the covenant. The covenant must be recorded once all reviewers have approved the site and no outstanding comments remain. Zoning will approve the site plan once the covenant has been recorded and copies provided to Zoning. Call me if there are any questions related to the covenant. DS 2-02.2.1.A.2

3. This comment was not addressed. A four-foot wide sidewalk is required between the building and the parking spaces along the eastside of parcel two. This sidewalk must be four feet in width, constructed of concrete and must be physically separated from the vehicular use area. The sidewalk must provide access to Jackson Street and Broadway Boulevard, which in turn will provide the access to the building. See redlines.

In addition the plan must demonstrate what use or purpose the remaining open area on parcel two will serve. It is obvious that the existing and previous use of the lot was specifically for parking. If the open area is to be used for parking spaces the spaces must be depicted and dimensioned on the plan.

Previous Comment: Clarify how access from the building is provided to the parking area on lot two. Draw, label and dimension the required pedestrian circulation/sidewalk. The pedestrian access should be an accessible route as well. DS 2-02.2.1.A.12

4. All easements must be abandoned prior to approval of the site plan. (It may be possible to allow the abandonment requirement time period to be extended to the building phase.) It is preferable that the easements be addressed as soon as possible and prior to site plan approval. It is also acknowledged that there may be a timing issue due city protocol when abandoning or vacating easements as well as right of way. Please inform the Zoning reviewer as to the status of the vacation of right of way along Broadway and the abandonment of the pedestrian easements.

The existing electrical easement cannot be abandoned by the City of Tucson. The applicant must contact Tucson Electric Power and request that the easement be abandoned. Provide any and all documents related to easement abandonment and list the recordation information on the plan as a note with docket and page.

Provide a document for the easement where the transformer has been placed. If an easement has not been recorded please discuss this issue with TEP and ensure that an easement is delineated on the plan and that the document for the easemernt is recorded and the recordation information is listed on the plan.

Previous Comment: If applicable draw and label all existing or proposed easements. The location, width and purpose must be listed. DS 2-02.2.1.A.20

5. This comment will remain until a DRB review and approval of the plan has occurred. Please submit any documents from DRB with site plan package.

It is my understanding that a DRB pre-conference meeting was attended but the application and proposal was never submitted. The DRB review and approval must occur prior to approval of the site plan.

RESUBMITTAL REQUIRED: SITE PLAN


1. Add sight visibility triangles (SVT) for the ingress/egress (Lot 1 and 2) to Jackson Street. The near side length is 185' and the far side length is 110'. DS 2-02.2.1.A.10.

The above comment is from the first review. It is acknowledged that the SVTs have been added as requested. However the existing (interior) SVTs is not necessary to show on the plan due to the fact the 18' curb returns and the sidewalk is essentially the approved proposed design. The existing (interior) SVTs clutter the site plan. For site plan clarity please remove the existing SVTs.

2. Keynote number 26 indicates proposed new sidewalk with 18' curb returns. Indicate in the keynote the width of the sidewalk.

3. Label and dimension from street centerline of Jackson Street to the front of the new curb and sidewalk. Revise. DS 2-02.2.1.

4. All easements of record must be graphically shown on the plan together with recording docket and page reference. Revise as necessary. DS 2-02.2.1.A.20

The above comment is from the first review. The existing electrical easement must be abandoned by Tucson Electric Power. See Zoning comments number 4. Revise the site plan notation accordingly. Provide the easement abandonment recordation information (docket and page) and the revised plan.

5. It is acknowledged Keynote 20 indicates land being purchased from COT by the owner, once this land is purchased this creates a new property line. In addition to the current ROW dimension include a dimension from street centerline of Broadway Blvd to the "new property line" and label or add an appropriate keynote to clearly indicate the new property/ROW line upon the land acquisition. DS 2-02.2.1.A.21.

6. New projects consisting of 3 or more dwelling units will provide centralized on-site refuse storage, collection and pickup areas. The pick up area for the refuse storage is located within the Right of Way (ROW), this location does not mean the requirements of DS 6-01. For alternative proposals contact John Clark of Environmental Services @ 791-3175 ext. 1136 to reach an agreement. Solutions that don't meet the Development Standards require a Development Standards Modification Request (DSMR).

The above comment was from the first review. It is acknowledged that John Clark of the Environmental Services Department accepts the current design solid waste proposal. However the current proposal does not meet Development Standard 6-01 and will require a Development Standards Modification Request (DSMR). Please contact Patricia Gehlen, Community Design Review Committee (CDRC) Manager for DSMR submittal criteria.
