5) The screening requirement is in addition to the landscape requirements. 10/20/2005 DAN CASTRO ZONING REVIEW Denied COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed. Applicant has indicated that a variance will be applied for the following comments.

1. Variance to be applied for:
Per LUC Sec. 3.2.6.4 Perimeter yard Indicator "DD", the minimum building setback shall be based on one and one-half times the building height. Proposed height of 19 feet 7 seven inches requires a minimum setback of 29 feet 4 inches. (D.S. 2-02.2.1.A.7)

2. Variance to be applied for:
This project requires 18 vehicle parking spaces. (LUC Sec. 3.3.4 General Manufacturing)

3. Variance to be applied for. A Temporary Revocable Easement (TRE) is also required for required on-site vehicle parking spaces located in the public right-of-way.
It appears that only one (1) vehicle parking space provided achieves on-site maneuverability required by LUC Sec. 3.3.7.5. All other vehicle parking spaces may not use the street for maneuvering. Vehicle parking space may not be located in the right-of-way without a temporary revocable easement (TRE) approved by the Real Estate Division of the Transportation Department. (D.S. 2-02.2.1.A.8)

4. A variance may not waive a federal accessibility requirement. One of the vehicle parking spaces provide will have to be a van accessible parking space and access aisle.
Previous comment: One (1) van accessible handicap parking space is required per 2003 International Building Code Section 1106.1. A fully dimensioned handicap parking space, access aisle, and accessible ramp shall be provided. Refer to American National Standard ICC/ANSI A117.1-2003 book for specifications. (D.S. 2-02.2.1.A.8)

5. Variance to be applied for.
LUC Sec. 3.2.8.4 requires on-site pedestrian facilities comply with Development Standards 2-08. D.S. 2-08.4.1.A requires at least one (1) accessible sidewalk be provided to a project from each street on which the project has frontage, unless there is no vehicular access from a street because of a physical barrier, such as a drainageway or an unbroken security barrier (e.g., a wall or fence). The sidewalk should be located to minimize any conflict with vehicular access to the project. (D.S. 2-02.2.1.A.12)

6. Variance to be applied for.
The proposed loading zone may not be located in the travel lane. Relocate the required loading zone to an area not allocated for another purpose. (LUC 3.4.3.2) (D.S. 2-02.2.1.A.14)

7. Variance to be applied for.
Per LUC Sec. 3.4.5.1, one (1) 12' x 55' loading zone is required for this project. The plan proposed a 12' x 35' loading zone. (D.S. 2-02.2.2.A.5)

8. If a Board of Adjustment variance is applied for and approved, please list the following as a general note: variance case number, date of approval, variances granted, and any conditions imposed.

RESUBMITTAL REQUIRED: SITE PLAN


1. The far side sight visibility triangle is not required. Please remove. DS 2-02.2.1.A.10.

2. Indicate the points of egress and ingress including locations and width of driveways and parking area access lanes (PAALs). DS 2-02.2.1.A.11.

This comment will continue to be addressed until the variance is approved.

3. At least one (1) sidewalk will be provided to a project from each street on which the project has frontage. The sidewalk should be located to minimize any conflict with vehicular access to the project. Revise the plan to show sidewalks to 44th Street. DS 2-08.04.

This comment will continue to be addressed until the variance is approved.

4. Is their sidewalk along 44th Street (within the ROW)? Sidewalks are required as part of new development of all properties. All new development shall provide 5 foot wide sidewalk along the entire length of the street frontage. The space between the curb and sidewalk within the ROW is a minimum width of two feet. The space is reserved for traffic signs, fire hydrants, etc. Revise the site plan to show this space. If existing sidewalk is already located with the ROW indicate accordingly. Otherwise indicate a proposed 5' sidewalk within the ROW. DS 3-01.2.7.B., DS 3-01.3.3.A.

This comment will continue to be addressed until the variance is approved.

5. It is acknowledged that the solid waste enclosure has been relocated. There is concern on how the solid waste truck is entering the enclosure. How will the vehicle access the dumpster? Maneuverability for the collection vehicle must be demonstrated. Be aware refuse vehicles require 36' inside radius and 50' outside radius. The collection vehicle can not back up into the pedestrian walkway or the street. John Clark must approve this proposal and a DSMR could be required. Revise accordingly. DS 6-01.
