COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Per the LUC, Sec. 6.2.2 (bedroom definition), the submitted site plan shows this residence will have a total of five (5) bedrooms. The plan labels three (3) existing bedrooms and a family room area meeting the LUC definition of a bedroom. The bedroom/garage addition, as proposed, will create a total of five (5) bedrooms on the site. Per Sec. 3.7.5.1.G, the current R-1 zoning of the lot requires three (3) vehicle parking spaces to be provided for five (5) bedroom properties, as described in comment 2 below.

2. Per the LUC Sec. 3.5.7.1.H, please note the following requirements. For all single-family dwellings in the R-1 zone with five or more bedrooms, all parking and maneuvering must be located on-site, either in a side or rear perimeter yard - and alley access is not permitted. The vehicular use area must be improved, which includes surfacing, striping, and provisions of barriers in conformance with Development Standard 3-05.0. Vehicle parking spaces may not be located in a vehicular use area in any front street perimeter yard.

The submitted plan shows partial parking for this project (two of the three spaces needed) accessed off the south alley. As proposed, the access to this parking garage does not meet the Zoning Administrator's interpretation regarding alley access. Alley access is prohibited to single-family residences with five (5) bedrooms. Please redesign the project to meet the Land Use Code requirements of sections 3.5.7.1 G and H, as outlined above. The alternative is to apply for and obtain a Board of Adjustment variance to this code requirement.

3. The floor/site plan shows a new kitchen as part of the proposed addition at the east side of the site. Please note with dashed lines where the existing kitchen is positioned, and that it is to be relocated per the submitted plan.

4. Per the LUC, Sec. 2.3.4.2.G, the R-1 zoning of this property requires a setback of six (6) feet or 2/3 the height of the proposed exterior building wall from the side yard property lines. The proposed east side garage/bedroom addition shows a setback of zero (0) feet and a kitchen/bathroom addition listed as four (4) feet. Based upon the proposed building wall height at the east property line of 14'4", the required minimum setback for the proposed additions to the east property line are 9'6". Please provide the correct minimum setback on the resubmittal. The alternative is to apply for and obtain a Lot Development Option (LDO) for reduced setbacks at the east property line.

5. Per the LUC, Sec. 2.3.4.2.G, the R-1 zoning of this property requires a setback of six (6) feet or 2/3 the height of the proposed exterior building wall from the side yard property lines. The proposed south side garage addition shows alternating setbacks of zero (0) and four (4) feet. Based upon the proposed building wall height at the south property line of 14'4", the required minimum setback is 9'6" at the south property line. Please provide the correct minimum setback on the resubmittal. The alternative is to apply for and obtain a Lot Development Option (LDO) for a reduced setback at the south property line.

Per the Zoning Administrator's determination, alley access is not allowed to this proposed development. The garage, as proposed, cannot be approved without a Board of Adjustment variance granted to allow access.

Should the applicant wish to apply for the Board of Adjustment, several issues represented in these comments can be addressed; alley access to parking spaces in the rear yard, and the proposed reduced setbacks off the east and south property lines for the proposed additions.

6. Please indicate the locations and label all utility lines on the site plan.

7. These are not final comments for an official Board of Adjustment variance referral. Should the applicant wish to seek variances for this project, please contact me for review of any revisions to the proposed plan and for comments to be referred to the Board of Adjustment process.
