1. Please include a response letter with the next submittal that states how all comments have been addressed.

2. General requirements criteria for Fill. This criteria applies to all non-residential developments, and all residential developments with lots that are less than 24,000 square feet, that are adjacent to an existing residential development or residentially zoned property (excepting multifamily developments greater than single story), or unsubdivided non-commercial property. This criteria does not apply to phase boundaries within a master planned development or to individual lots within the interior of a residential development, or to small swales and drainage rills.

A. Placement of fill in excess of two (2) feet [or a finished floor elevation (FFE) in excess of two (2) feet plus the slab thickness] above existing grade at any location in the outer one hundred (100) feet of the developing site (less any intervening non-developable property outside of the site) shall require:

1. Written justification based on engineering/technical reasons.

2. Written permission of the Director of the DSD (DSD).

3. Notification of the property owner(s) adjacent to the fill site (with copies to the Council Office and the Director of DSD) prior to the approval of a grading plan. Said notification shall include reference to this ordinance, the justification presented as the basis for the excess fill, the approval letter from DSD, and the name, address, & phone number of the owner/developer and the engineer of record. This notification shall occur early in the development process.

4. Preparation of a mitigation plan (i.e. additional setbacks, terracing, enhanced buffering/landscaping, etc.) acceptable to a simple majority of the notified property owners. The acceptability of the mitigation plan by the notified property owner(s) must be documented and made a part of the approved grading plan and permit. If the owner/developer and the notified property owner(s) cannot reach consensus on a mitigation plan within 15 working days of receipt of the property owners, the Director of DSD shall review the issues and information and then render a final decision.


Monitoring of grading activities shall be the responsibility of the engineer of record and certification of FFE's shall be done by a registered land surveyor hired by the permittee. Regulation, inspection, control of work, and enforcement of the above criteria shall be the responsibility of the Director of DSD as stated in DS 11-01.8.0
07/29/2005 JOE LINVILLE NPPO REVIEW Denied 1. A Native Plant Preservation Plan per Development Standard 2-15.3.0 is required.

2. An aerial photograph, taken within a maximum of three (3) years of submittal, at a minimum scale of 1" = 60' showing the site's boundaries, the locations of all Protected Native Plants within those boundaries, and the plants' identification numbers keyed to the inventory list in Sec. 2-15.3.1.A.2. Any aerial photograph submitted, which was taken more than one (1) year prior to submittal, shall be accompanied by a letter stating that the site is substantially unchanged from the date of the aerial photograph.

3. Preparation of all elements of the Native Plant Preservation Plan as required under LUC 3.8.6.7.D shall be performed by a plant professional, such as:
A. An arborist certified by the International Society of Arboriculture.
B. A landscape architect.
C. A horticulturist, biologist, or botanist with a minimum B.A. or B.S. in an appropriate arid environment natural resource field.

1. The grading plan has been reviewed by Zoning Review Section but cannot approve the plan until it has been approved by the Engineering and Landscape Review Sections and zoning comments or concerns have been addressed.

2. Zoning will re-review the grading plan on the next submittal to insure compliance with the approved site and landscape plans.

3. Two copies of the approved and stamped site plan, landscape and NPPO plans must be included with the grading plan.
