GRADING PLAN CONDITION OF APPROVAL: 1) DS Sec.10-02.2.2.5.D: Floodplain Use Permit required and must be posted at the site. November 22, 2004 FLOODPLAIN USE PERMIT # T04OT02014 PROJECT ADDRESS: 1036 North Anita Avenue APPLICANT'S NAME: Considine Custom Construction, LLC PROPERTY OWNER: Kevin Considine The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: Parcel 116-16-0040, at 1036 North Anita Avenue, Tucson, in a portion of Township 14 South, Range 13 East, Section 11, called Lot 5 of block 1 of Amended MCKINLEY PARK, Book 3/page 26, for the purpose of grading improvements and placement of a mobile home on a residential parcel. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following 10 conditions apply to this permit: 1) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the structure and / or site development, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. 2) This parcel lies in a FEMA AO (1 foot depth) Zone (map number 04019 C 2226 K). The finished floor of the home shall be a minimum of two feet above the highest existing natural grade per the project engineer. All work shall conform to all recommendations as set forth in the Hydrology Letter dated October 19, 2004 by John M. Wallace, PE of JE Fuller / Hydrology & Geomorphology, Inc. 3) All work shall conform to the Site / Grading Plan (approval date 22NOV04) which is made part of this permit. All floodplain use permit conditions apply also to the associated Site / Grading Plan under T04BU02438. 4) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. There shall be no disturbance or stockpiling outside of the grading limits. 5) WITHIN 5 (FIVE) DAYS OF ISSUANCE OF THIS PERMIT, THROUGH COMPLETION OF THE PROJECT, NOTIFICATION MUST BE POSTED AND MAINTAINED IN A CONSPICUOUS PLACE ON THE JOB SITE STATING "Construction proceeding under requirements of City of Tucson Floodplain Use Permit # T04OT02014. For information please call 791-5550." 6) A Right-of-way Use Permit is required for any construction in within the right of way. 7) Any walls to be constructed will require a separate grading and building permit. 8) This Floodplain Use Permit does not authorize the construction of the building pad or building of structures. Any construction shall be authorized by a separate building permit. 9) Special inspection and Elevation certificate required. The lowest structural member under this permit shall be placed as shown on the approved plans and shall be a minimum of 2 feet above natural existing grade, as Certified by a Registered Land Surveyor. Registered Land Surveyor shall fully complete and construction shall adhere to specifications outlined in Section C of the elevation certificate. The Elevation Certificate along with the Certificate of Manufactured Home Anchoring and Utilities Location, shall be submitted upon completion of grading and returned to City of Tucson Development Services Department on the 1st floor of the County/City Public Works Building at 201 North Stone Avenue, Tucson Arizona 85726. 10) Please call Development Services Department at 791-5550 or 740-6970 (IVR) for inspection. This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
