PROPERTY OWNER'S NAME: K-Gam, LLC The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: W595.67' OF E 670.67' OF L 1 EXC S 30' N 30' FOR RD & EXC SPANDRELS 3.88 AC SEC 13-14-14 (10175/1085)(10703/1452) For the purpose of channel widening on the south bank of the Alamo Wash and construction of a bridge crossing in accordance with the approved grading plans referenced below. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Management Regulations (Section 26, Tucson Code), and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Management Regulations require the issuance of an additional Floodplain Use Permit. The following conditions apply to this permit: 1) All work shall conform to the attached Grading Plans For Alamo Wash (DSD activity # T03BU03106), the approved drainage report for the Silo Parcel (revised on April 17, 2002), and drainage report addendum sealed on March 31, 2004, prepared by Rick Engineering Company, which are made a part of this permit. 2) The existing drainage patterns at the property lines shall not be obstructed, other than as may be shown on the approved grading plan and/or described in the approved Drainage Report. 3) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 4) Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T04OT00459. FOR INFORMATION PLEASE CALL 791-5550." 5) This permit becomes invalid and is subject to an additional floodplain permit application and review, if any proposed or required modifications result in development within the floodplain other than as approved herewith. This Floodplain Use Permit becomes invalid and will be automatically revoked if development onsite results in non-compliance with conditions set forth in this permit. This permit will expire one year from its date of issue. Renewal of this permit will require a new application, review, and approval by the City of Tucson, Development Services Department, Engineering Division. APPLICANT: Rick Engineering Co. Inc.
